Town of Mashpee Conservation Commission <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MOTION: To give administrative approval for the proposed project of eel grass restoration <br /> plantings in Hamblin Pond. <br /> Motion by: Paul Colombo Seconded by: Richard Sahl <br /> Vote: Vote passed unanimously by roll call vote <br /> (Steve Cook, Paul Colombo, Richard Sahl, Seana Pitt) <br /> o Enforcement Order Signature for 14 Little Neck Lane <br /> Conservation staff reported that 14 Little Neck Lane had recently appeared before the Commission under a Notice of <br /> Intent application at the prior meeting. Following site visits by the Chair, staff, and other commissioners, it was <br /> observed that lawn had been installed directly on the coastal bank following cutting and site alteration in that area. <br /> Staff stated that an enforcement order would be issued requiring restoration of the affected coastal bank area. <br /> Commissioners noted that the restoration review would encompass the broader affected property area, and staff <br /> clarified that the applicant would be required to undertake a restoration plan for the coastal bank. <br /> o Enforcement Order Signature for 106 Wheeler Road <br /> Conservation staff reported that an enforcement order was being issued for 106 Wheeler Road due to multiple <br /> apparent violations currently under review. Staff stated that substantial fill had reportedly been brought onto the <br /> site, including material used to create a revetment-type structure along the pond, and that a deck had also been <br /> installed. Staff noted that the matter involved multiple compliance issues requiring further review and ongoing <br /> discussions with the property owner. <br /> Staff further explained that the matter implicated not only Conservation Commission review, but also Building <br /> Department permitting requirements, including at least the deck structure. A commissioner also noted the <br /> presence of a partially submerged dock in the water, and staff confirmed that there was an existing active permit <br /> associated with the property that would need to be addressed as part of the overall compliance review. <br /> Discussion addressed enforcement procedure and timelines. Staff indicated that deadlines for compliance would <br /> be established through the enforcement process and confirmed that daily fines could be imposed for failure to <br /> meet required deadlines. Staff recommended that the property owner be required to submit a compliance or <br /> restoration plan for Commission review and discussion, after which the Commission could determine the <br /> appropriate path forward. Staff requested commissioner signatures so the enforcement order could be issued <br /> promptly, and stated that the Commission would be kept updated as the violations were addressed. <br /> (This space is reserved for topics that the Chairman did not reasonably anticipate would be discussed). <br /> 3 <br />
