of TMs s,s <br /> z. <br /> Aannin Board <br /> c� <br /> 16 Great Neck Road North <br /> .wlashpee, Aassachusetts 02649 <br /> Request: Special Permit Application to construct a 13,229 +/- SF specialty <br /> retail grocery store on 3.97 +/- acres of undeveloped land pursuant <br /> to Sections 174-24(C) & 174-25(E)(1) & E(2) of the Mashpee <br /> Zoning By-law. <br /> Chair Mary Waygan read the public hearing notice into the record. <br /> Christopher Kirrane is present this evening representing the applicant, Mark Bogosian, and <br /> accompanying them is their team, Jason Adams from Bowman Consulting and representatives <br /> from Trader Joes. They received the draft decision from the Town Planner that morning and he <br /> has some comments regarding the decision. There are smaller typographical items he can <br /> speak with the Town Planner about, notably the word duly. <br /> Mr. Kirrane continued that there are conditions he wanted to note, particularly number 13, <br /> where they offered to have the traffic consultant provide up to 40 hours of consulting work. That <br /> was removed, and if there is no cap on it, they could be spending insurmountable amounts, and <br /> they thought 40 hours was reasonable for consultation. If the Board wants to propose another <br /> number, they are fine with that. <br /> Ms. Waygan inquired if waivers and inclusions are present. <br /> Mr. Kirrane confirmed, then referenced the beacon lights where the applicant will maintain the <br /> beacon lights under condition Number 11. There is no real issue with that, but it is really a DOT <br /> matter, that may be tweaked to say subject to a DOT approval. <br /> Attorney Kirrane continued to Number 26, dealing with other outstanding issues and Mark Dibb <br /> accounted for the buffer meeting the bylaw. Under Comment 6, the delivery truck circulation <br /> route, refers to trucks utilizing the right turn only exit. From their perspective, it's not practical <br /> because trucks would be sent to Falmouth and there are only two delivery trucks a day. <br /> Mr. Tobin commented these are outstanding issues to iron out, and Comment 6, under <br /> numbered Condition 26, is just ensuring these items get addressed. <br /> Mr. Kirrane stated the traffic verbiage seems inconsistent, when saying "increasing probability <br /> of accidents". <br /> Mr. Balzarini agreed and asked if that was in reference to Number 19. <br /> Mr. Kirrane answered yes, and other items that seemed inconsistent with the language of an <br /> approval. An acceptable example would say, this Board finds that traffic does not have an <br /> adverse impact, or this Board finds data and methodology are acceptable based on industry <br /> 2 <br />
