MASHPEE ZONING BOARD OF APPEALS <br />Meeting Minutes <br />June 10, 2026 <br /> <br />Attorney Christopher Kirrane represented the homeowners request for a Written <br />Finding to construct an inground pool. Also present was Pam Aggerbeck. <br /> <br />At the last hearing, the Board had some questions regarding the building envelope <br />area on the site plan. This building envelope was created for the amendment of the <br />master deed back in 1997. The Board questioned if any construction was allowed <br />outside that building envelope. Attorney Kirrane provided a letter from the <br />Willowbend Architectural Review Committee stating that they approved the pool <br />project. Willowbend has historically waived the requirement on multiple projects to <br />be within the building envelope and to allow construction outside the building <br />envelope on multiple projects. It’s not a Zoning issue. The Conservation Commission <br />approved the project with 1,800 sq. ft. of mitigation requirements. <br /> <br />Mr. Reidy read a letter from Dennis Ring, dated June 9, 2026, addressed to Attorney <br />Kirrane and the Board that the ARC has no issues and approved the project. <br /> <br />Mr. Furbush had concerns that Willowbend does not have any setback requirements <br />and the site plan did not depict any dimensions for the pool or the cranberry bog. <br /> <br />Mr. Bonvie mentioned that he read all the Willowbend legal documents and <br />particularly the crosshatched area of exclusive use or no crosshatched areas on the <br />site plan. He believes that those documents require some revision. <br /> <br />Mr. Reidy also read the Conservation Department Comments and the Board of <br />Health comments into the record. <br /> <br />Mr. Morris reiterated that this project is before the Board for the 50 ft. setback to <br />the wetlands, and the cranberry bog. He also agreed with the ARC approval letter <br />from Dennis Ring. <br /> <br />There were no comments from the audience. <br /> <br />Mr. Bonvie asked the Board to concentrate on the two reasons Mr. Morris submitted <br />this application the Board’s review which is setback from wetlands and setback from <br />the cranberry bog. He also mentioned that if the applicant submits a request in the <br />future that the Board may or may not be able to submit an approval. <br /> <br />3 <br /> <br /> <br />
