Town of Mashpee Shellfish Commission <br /> 16 Great Neck Road North <br /> Mashpee,MA 02649 <br /> 2026, and requested that the Commission move its July meeting to July 7, 2026,to allow sufficient time for <br /> legal review, Commission consideration, and submission of the proposed warrant article. <br /> Mr. Tomaino stated that once the proposed bylaw language and warrant article had been prepared, they would <br /> be provided to the Commission for review. He requested that the Commission consider taking a vote of <br /> support or non-support at its July 7, 2026 meeting. He further stated that the warrant article would be <br /> submitted by the Department rather than the Commission but that he would appreciate a formal vote of <br /> support from the Commission. <br /> Mr. Thomas stated, for the record, that the concept had originally been raised by Mr.Avis <br /> approximately six months earlier. Mr. Thomas explained that Mr. Avis had expressed concerns regarding <br /> serving as both an operational employee and a voting member of the Commission. Mr. Thomas stated that he <br /> had discussed the matter with Town staff at that time and had been advised that the issue could be pursued <br /> through a future Town Meeting warrant article. Mr. Thomas further stated that the discussion predated the <br /> recent Quiterio matter and was unrelated to that issue. <br /> Discussion followed regarding the separation of operational and advisory responsibilities. Members generally <br /> agreed that maintaining separate roles for Division operations and Commission oversight would provide <br /> greater clarity and avoid situations in which an operational employee could be required to vote on matters <br /> affecting Division activities. <br /> Mr. Tomaino stated that, once finalized, the proposed bylaw language and warrant article would be distributed <br /> to the Commission in advance of the July 7, 2026,meeting to allow adequate review and discussion. <br /> Following discussion, the Commissioners expressed agreement with moving its July meeting from July 14, <br /> 2026, to July 7, 2026, to accommodate the warrant article deadline and review process. No formal vote was <br /> taken regarding either the meeting date change or the proposed bylaw amendment. <br /> ADDITIONAL TOPICS <br /> Chair Thomas shared that he and Mr. Cook recently saw Shellfish Commission Member Bill Holmes at the <br /> Rod& Gun Club.
