MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 22, 2026 <br /> Sitting on this hearing are the five regular Board members. <br /> Mr. Morizio made a motion that the Board approve the continuance request until <br /> Wednesday, September 9, 2026. Mr. Reidy second. All were in favor. <br /> NEW HEARINGS <br /> 9 Tuspaquin Road: Owners, Mario and Gina Recupero request a Special Permit <br /> under §174-17.1, §174-17, and §174-31 of the Zoning Bylaws to raze an existing <br /> one car garage with a new one car garage in the same footprint with living space <br /> above on property located in an R-3 Zoning District, Map 72, Parcel 8, Mashpee, <br /> MA. <br /> Sitting on this hearing are the five regular Board members. <br /> Mr. Michael Cannata represented the Mario and Gina Recupero, the owners <br /> requesting to raze and replace their single car garage with living space above. <br /> The garage is pre-existing nonconforming to the right side and from the front lot <br /> line. The new garage will be built in the same location with a bump out on the <br /> left side and will not encroach on the side setback. The lot coverage will increase <br /> from 16% to 18% and is still under the 20% requirement. A floor plan of the <br /> garage shown to accommodate one car and there is plenty of parking in the <br /> driveway. <br /> Mr. Morris mentioned to the Board that the raze and replace is the best approach <br /> because the existing garage is on a slab. <br /> Mr. Reidy read the Conservation Department comments dated July 21, 2026, <br /> into the record; "Garage was issued an Administrative Approval due to a majority <br /> of the structure is outside of the buffer zone with only new structure being access <br /> stairs for building egress." <br /> Mr. Reidy read the Board of Health comments dated July 20, 2026, into the <br /> record, "Property to remain 2 bedrooms as long as it is connected to Septic. Space <br /> above garage does not meet requirements for human habitation and cannot be <br /> used as a bedroom." <br /> Ms. Sangeleer read a memo from Drew McManus, Conservation Agent dated <br /> June 23, 2026, into the record. <br /> Mr. Goldstein wanted to confirm the increase in footprint. Mr. Morris said it <br /> should have been worded; "same setback". <br /> 2 <br />
