MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 22, 2026 <br /> Only July 17, 2026, a letter was emailed and delivered to the ZBA Office from <br /> Attorney Mills on behalf of the Owner of 22 and 26 Oyster Way. <br /> That letter was a request to dismiss the appeal. On July 21, 2026, Attorney <br /> Trevisan filed an opposition that included several affidavits to support the <br /> appeal. The appeal 1973 subdivision plan contained a notation; not a buildable <br /> lot for both 22 8v 26 Oyster Way. That subdivision plan was never modified as <br /> part of the statue. The 2020 ANR plan cannot be used to modify the notation on <br /> the subdivision plan that the lots are not buildable, and the properties cannot <br /> rely on River Rd to satisfy the 150 ft. frontage requirement under the Zoning <br /> Bylaws. Based on this information, the Attorney Mills asked that the Zoning <br /> Board deny the building permits and issue that the Building Commissioner do <br /> the same. <br /> Mr. Reidy summarized a letter submitted by Attorney Rob Mills, dated July 16, <br /> 2026, requesting that the Zoning Board dismiss the appeal AP-2026-29. <br /> Mr. Reidy read the last sentence of Tom Fudula's affidavit dated July 20, 2026; <br /> "Based on the above facts, I do not believe that either 22 or 26 Oyster Way <br /> qualifies for approval of a Building Permit." <br /> Mr. Bonvie confirmed with Attorney Trevisan that she had documents read into <br /> the record. <br /> Mr. Reidy read a memo into the record from Brian Tobin, Town Planner dated <br /> July 22, 2026, addressed to the Zoning Board of Appeals. <br /> Mr. Bonvie asked if the Findings submitted by Town Counsel dated July 22, <br /> 2026,be read into the record. <br /> Mr. Reidy read the Findings dated July 22, 2026, into the record. <br /> Mr. Morizio read the Board of Health comments dated July 20, 2026, into the <br /> record; "No comment". The Conservation Comments dated July 21, 2026, into <br /> the record; "Not within wetland jurisdiction. " <br /> Mr. Morris had no comments. There were no comments from the Board. <br /> Mr. Bonvie asked for audience comments and will allow responses from Attorney <br /> Trevisan. <br /> 4 <br />
