r. X .vs. BUILDING CODE 'down of Mashpee � Massachusetts d I. GENERkL Section 1. Purpose . To promote the health, safety, moral and general welfare of its inhabitants, to lessen the danger from fire, and to improve the Town, the construction and alterations of buildings in the Town of Mashpee are hereby restricted and regulated as provided under the provisions of Section 3 , Chapter 143 , of the General Laws . Section 2. Relief from Personal Responsibility. The officials , officers or employees charged with the enforcement of this code shall be held harmless from legal responsibility, and reimbursed for financial liability incurred in the discharge of their official, duties. Section 3 . Title . These by-laws shall be known as the Mashpee Building .Code'. 1 Section 4 . Continuance of Former By-Laws-Repeal. The provisions of these by-laws , so far as they are the same as those of existing b;r-laws , shall be construed as continuations thereof and not as new enactments . A reference in a by-law, which has not been repealed, to provisions of by- laws which are revised and re-enacted herein shall be construed as apply- ing to such provisions as so incorporated herein . All by-laws or parts of by-laws heretofore passed, inconsistent herewith, are hereby repealed. Section Validity . The invalidity of an, section or provision of these by-laws shall not invalidate any other section or provision thereof.. Section 6. Amendments . These by-laws may be amended from time to time by a two-thirds vote at an,,,, annual or special Town Meeting, provided that the proposed amendment shall be included as an article in the warrent for such Town Meeting. COT,STRUCTIOA, II . REGULATIOT, S . Section 1. Notification of intent,. to Build, etc . Para. 1 . A permit shall berequiredfor all buildings to be erected, altered, reconstructed or mov:ed :to.'a new-founda_ ion within the limits of the Town of Masrrpee , excepting small unattached accessory buildings`. not to be used. for the purpose of habitation and having a floor space of le.s.s , ' than 100 square feet . Para. y2 . This code shall not apply to : 1. Buildings for which a Commonwealth of 1�, assachusetts permit is required . 2. Buildings or structures owned by the United States or the Commonwealth of Massachusetts . 3 . Bridges , quays , wharves . 4. Farm buildings or structures not in either case used as dwellings and located more than 100 feet from any dwelling, if approved by the Building Inspector . 5 . Ordinary repairs to buildings, providing such repairs do not include the removal of walls which tend to weaken the building. Section 2. Applications . Applications for building permits shall be
