i <br /> 9.319 Building Permits — The developer shall submit <br /> to the Building Inspector prior to the issuance of <br /> a building permit with his application for a <br /> building permit a copy of the approved sub- <br /> division plan together with evidence that the <br /> project phasing schedule is being adhered to by <br /> the developer. <br /> 9.391 Changes or deviations from plans, schedules, and <br /> phasing may be made only with the unanimous <br /> approval of the Board of Appeals. <br /> 9.3.92 The Building Inspector may revoke by-law in <br /> case the builder or developer fails to conform to <br /> the plans and schedules as approved. <br /> 9.4 Exception for Cluster Development. <br /> 9.41 Purpose: To encourage the preservation of open space <br /> and promote the more efficient use of land, and to <br /> protect and promote the health, safety and general <br /> welfare of the inhabitants of the town. <br /> 9.42 Any provisions of Section 7 of this By-Law to the con- <br /> trary notwithstanding, the Board of Appeals may grant <br /> a Special Permit approving a cluster development in a <br /> residential district for a tract of land 20 acres or more <br /> in which some or all of the lots do not conform to the <br /> lot area, frontage, set back, or yard requirements of <br /> Section 7 of this By-Law, provided that the Board of <br /> Appeals makes a finding that the public good will be <br /> served and further provided that the following criteria <br /> are met: <br /> 1. The proposed plan will promote the purpose of this <br /> section. <br /> 2. The total number of lots for building purposes <br /> within-the tract shown on the plan shall be not <br /> more than the number of times that the total area <br /> of the tract, in square feet,- exclusive of roads, <br /> is wholly divisible.. by the minimum lot, size, in <br /> square feet; normally required for the district in <br /> which the tract is located. <br /> 3. The lots for building purposes shall be grouped in <br /> a cluster or clusters, and within each cluster the <br /> lots shall be contiguous. <br /> 4. Each lot shall have a minimum frontage of seventy- <br /> . P <br /> 32 <br />
