The complainant,Jeffrey Williams,visited the respondent's pool store.There,he spoke with the <br /> respondent about the panels, asvell as his concern that his voice messages had gone unreturned. <br /> _ 15_ After the discussion,the respondent agi+eed to come to the job site later that day and_look_at the. <br /> work Upon reviewing the work,the respondent agreed with the complainant's assessment and <br /> told him that work to correct the problem would ensue the next morning,on June 6, 2014. <br /> 16. Neither the respondent nor any agents or representatives came to the pool site the morning of <br /> June 6.The complainant,Jeffrey Williams,called the respondent using one of two available <br /> mobile phone numbers.However,he was unable to reach the respondent. <br /> 17. The complainant,Kara Kelleher,visited the respondent's pool store the morning of June 6 and <br /> spoke with a customer service representative named Corey.The complainant told Corey that they <br /> were very concerned that no one has begun to correct the problem with the pool and that the <br /> respondent was not returning their phone calls. Corey told the complainant that he would relay <br /> the message to the respondent as soon as possible. <br /> 18. The complainants continued to call the respondent and leave voice messages throughout the rest <br /> of the day.Around mid-morning on June 6,Corey called the complainant,Kara Kelleher, and <br /> told her that he just spoke with the respondent,who was now on his way to the pool site. <br /> • M In the early afternoon of June 6,the respondent sent the following text message to the <br /> complainant,Kara Kelleher. "I'm in ER I'll call later." <br /> 20. Neither the respondent nor any agents or representatives came to the pool site at any time on June <br /> 6,2014. <br /> 21. On June 7,2014,the respondent sent text messages to the complainant,Jeff Williams,explaining <br /> that he was going to be released from a hospital,as he had been admitted due to a blood clot in <br /> the lung. <br /> 22. After the text message and explanation about-the hospital;-the respondent did not communicate <br /> with the complainants again on June 7,2014. <br /> 23. During the afternoon of June 7,the complainants went to the address of homeowners who hired <br /> the respondent to install a pool and spoke with them about their experience. <br /> 24. On June 8,2014,the complainant,Jeff Williams,drove to another address where,according to a <br /> posting on the company Facebook page,the respondent had installed a pool. <br /> 25. Upon arrival,the complainant saw the respondent cutting down trees and working in the yard. <br /> 26. During the increasingly heated discussion,the respondent told the complainant that he would be <br /> • at the pool site the next day to come up with a plan to 5x the problems.The complainant also <br /> learned at that time that the address belonged to the respondent's girlfriend. <br /> Page 3 of 7 <br />
