MINUTES January 26, 1995 6 BOARD OF HEALTH <br /> *****OLD BUSINESS***** <br /> Request for landfill sticker-Ms Roberts <br /> Mr. Doherty stated, "I spoke with Ms. Roberts who explained the situation." "I <br /> forwarded my approval to issue a landfill sticker." <br /> *****NEW BUSINESS***** <br /> Variance request - Nursery. Route 151 <br /> Mr. McQuaid relayed, "The owner is requesting a variance from the regulation <br /> which requires the installation of both a primary and reserve for commercial enterprises." <br /> "The proposed nursery retail space is so small that leaching only requires 83 gallons per <br /> day." "The engineer is providing 679 gallons per day." <br /> Mr. Doherty motioned to grant the variance relief as requested based on flow <br /> estimates, Mr. Cram seconded, all agreed. <br /> Mr. McQuaid commented, "The storage of pesticides will be discussed at the <br /> Board of Appeals hearing." <br /> Robert DeLory - 3 Bay Road <br /> Mr. DeLory was in attendance for discussion. <br /> Mr. DeLory stated, "I am an abutter and I never received notice of the variance <br /> request." <br /> Mr. Doherty informed Mr. DeLory, "No notification was required as it was not a <br /> Title V variance." <br /> Mr. DeLory stated, "The paper street is 32' long." "The street is not part of the <br /> deed." "Abutter's have a right to use the road." <br /> Mr. Ball informed Mr. DeLory, "The Board required Mr. Benway provide proof <br /> that he owns to the center of the road." "As of yet, we have not received a copy of the <br /> deed." <br />
