l <br /> MINUTES January 12, 1995 2 BOARD OF HEALTH <br /> APPOINTMENT - Melvin Reine - Five Star Enterprises <br /> Attorney Robert Mills was in attendance representing Mr. Melvin Reine owner of <br /> Five Star Enterprises. <br /> Mr. McQuaid relayed, "Five Star has always been somewhat in arrears on their <br /> Accounts payable." "When the year came close to its end Five Star was in arrears <br /> approximately $5,000.00." "This was a good time in which their account could be <br /> brought up to date as it was license renewal time." "This Board did direct me to forward <br /> a letter to Five Star notifying them that they must bring their account up to date by <br /> January 15th and that their bond was increased to $5,000.00." "Five Star agreed to bring <br /> their account up to date however, requested a meeting with this Board to discuss the <br /> increase in the bond requirement." <br /> Mr. Doherty stated, "The account status in the past is unacceptable." <br /> Mr. McQuaid commented, "I would recommend that if arrears are paid in full by <br /> the 15th the Board consider leaving the bond at $1000.00." "If they fall into arrears again <br /> in excess of $5000.00 the Board at that time shall require a $5000.00 bond within 30 <br /> days." <br /> Mr. Doherty relayed, "I would recommend the following; if the account is paid in <br /> full by the 15th we will not require a bond increase however, if at any time payments are <br /> late then the $1000.00 will be used to pay the balance, license renewal will be canceled <br /> and in order for Five Star to be reinstated they will be required to submit a bond in the <br /> amount of$5000.00." <br /> Mr. Doherty motioned to require Five Star Enterprises to pay their account in full <br /> by January 15, 1995 or their license shall be revoked and reinstatement will require a <br /> $50000.00 bond; if payment is made in full by January 15, 1995 their hauler's license shall <br /> remain in effect however, if any time payments are found to be 31 days past due they will <br /> be required to attend the next regularly scheduled Board of Health meeting to discuss <br /> possible license revocation or submittal of a bond in the amount of $5000.00, Mr. Ball <br /> seconded, all agreed. <br /> 6.) Pump system - 426 Monomoscoy Road - Mr. McQuaid relayed, "The owner is <br /> proposing a pump system to maintain the 4' from adjusted groundwater." <br />
