MINUTES January 15, 1998 3 BOARD OF HEALTH <br /> APPOINTMENT - Mr. Daniels -26 Melissa Avenue - Septic Upgrade <br /> W. Daniels was in attendance for this scheduled appointment. <br /> Mr. McQuaid relayed, "Mr. Daniels recently bought this property at 26 Melissa <br /> Avenue." "The septic system, upon transfer of property, was inspected and marginally <br /> passed, meaning that the cesspool was rootbound but the liquid level in the cesspool was <br /> less then 1' because the dwelling had not been occupied for some time." "When Mr. <br /> Daniels bought the property it was his opinion that the downstairs family room was not <br /> considered a bedroom therefore, he wanted to open up the garage and transfer the two car <br /> garage into a master bedroom." "He called me to go out and inspect the system." "I <br /> found it to be indeed rootbound, not in failure at the time of inspection but would <br /> obviously fail once the house was fully occupied." "I realized that even if I certified the <br /> system in failure, if he's increasing the habitable space our by-law states you have to have <br /> an engineer design an upgrade." "I informed the installer that we need an engineer to <br /> design the upgrade." "I spoke to Mr. Daniels about this and invited him before the <br /> Board." "It's in a non-wetland area." "I know what out policy is but I don't know if we <br /> have to enforce this in this instance." "I would recommend the installer design the <br /> repair/upgrade without having to go through an engineer." "The existing well that <br /> services the dwelling is 96' from the existing cesspool." "The upgrade would maintain a <br /> greater distance from the well." <br /> Mr. Daniels stated, "During the process I signed the offer to purchase and the <br /> Attorney that owned it wanted to sell it before the end of the year and I needed to before <br /> my Mother's operation and I had a chance to sell my house, get all my ducks in order so I <br /> figured a 330 gallon per day system I wouldn't have a problem." "I signed the purchase <br /> and sales after the home inspection, the termite inspection and everything else." "When <br /> my septic inspector came to do my house on 284 Simons Narrows Road I asked him to <br /> come over to Melissa Avenue because I couldn't find where anybody had dug up anything <br /> in the yard." "He came over and we dug around and finally found it and when we started <br /> to take the cover off there were a lot of roots on the top and I said to him I don't think <br /> this was dug up." <br /> Mr. Doherty questioned, "How can someone certify a system in working order <br /> when it never was looked at?" "Who did the first inspection?" <br /> Mr. McQuaid responded, "Mark DeDecko." <br />
