TOWN OF MASIIPEE <br /> BOARD OF I4EALTH <br /> February 5, 1998 <br /> Meeting called to order at 7:00 p.m. <br /> Members present: John T. Doherty and Robert F. Cram, Sr. <br /> THE TAPE IS NOT PART OF THE MEETING IT IS FOR THE PURPOSE OF <br /> TRANSCRIPTION ONLY. <br /> Mr. Steven R. Ball, Chairman <br /> 1.) Warrants signed. <br /> 2.) Minutes were continued until all Board members are in attendance. <br /> 3.) Copy of letter from Town Counsel to D.E.P. re: Landfill - Mr. McQuaid relayed, <br /> "If you recall, we were issued an "Order of Non-compliance" by the D.E.P. because <br /> Weston and Sampson failed to notify the D.E.P. of the arsenic and copper levels in the <br /> Mashpee River, which according to the D.E.P. back then required a 24 hour notice." "As <br /> a result of that we had to negotiate with the D.E.P. with the assistance of Paul Teraki <br /> from the southeast region that we would not be fined for this non-compliance, instead we <br /> would have to do an ecological risk assessment on the river and further study of the issues <br /> pertaining to the landfill groundwater contamination." "This letter states that the D.E.P. <br /> has in fact, reversed their position that the levels of contamination in the river did not <br /> require a 24 hour notification and that the town was not in violation of the requirements <br /> setforth by the D.E.P.." "It's a complete turn-around." <br /> Acknowledged. <br /> APPOINTMENT: Dave Rich- Floor Drains <br /> Mr. David Rich was in attendance for this scheduled appointment. <br /> Mr. Rich stated, "I am present this evening at the direction of the Department of <br /> Environmental Protection and the Board of Water Commissioner's." "The town of <br /> Mashpee does not to my knowledge have a floor drain regulation." "We are of the <br /> opinion that it is something that is of critical importance for the protection of the water <br />
