MINUTES March 19, 1998 3 BOARD OF HEALTH <br /> Mr. Ball commented, "If it was another well driller we would do the same thing." <br /> Mr. Ball motioned to reconsider their vote of March 12, 1998 with regards to the <br /> issuance of a letter to the Office of Water Resources, Dept. of Environmental <br /> Management informing them of Michael DiMaggio's violation, Mr. Cram seconded. <br /> Boards members agreed a verbal reprimand is all that is necessitated in this matter. <br /> 5.) Letter from D.E.P. re: C.S.A. - Mr. McQuaid stated, "I contacted Weston & <br /> Sampson and they are aware of the final additional information." <br /> 6.) Letter from M Grotzke re: Aunt Janes Road perc tests - Mr. McQuaid relayed, <br /> "In March of 1995 60 lots in the Aunt Janes Road area were perked." "There is this one <br /> area in Popponesset that is half Popponesset and half New Seabury." "I spoke with the <br /> Building Inspector about this." "There are some legal issues that need to be resolved as <br /> far as if this falls under Popponesset zoning or New Seabury zoning." "I have nine plans <br /> on hold because I didn't know which way the zoning applied to these lots." "Last week <br /> an installer came in to pull 28 permits knowing that the three year window expires at the <br /> end of March." "I informed the engineer I have problems with the lots due to the zoning <br /> and whether there are abutting wells and suggested he request 6 month perc extensions on <br /> the lots in question." <br /> Mr. Cram motioned to grant 60 day perc extensions from the date of expiration on <br /> the following lots: 55 Uncle Edwards Road and 3,4,6,7,10,14,15 and 16 Aunt Janes <br /> Road, Mr. Doherty seconded, all agreed. <br /> 7.) Variance request, 98 Shore Drive - Mr. McQuaid relayed, "The applicant is <br /> requesting a 5' sideline variance, a 1' variance from the bottom of the leaching facility and <br /> groundwater and 2' variance from the foundation." "This is an existing dwelling with a <br /> cesspool." "The engineer has stated this is a septic upgrade as the cesspool is in failure." <br /> "No increase in living space allowed." <br /> Mr. Doherty stated, "I am concerned with the depth to groundwater." <br /> Mr. Ball agreed. <br /> Mr. McQuaid stated, "On an existing failed system 4' of naturally occurring <br /> permeable soil is required between the bottom of the leaching facility and groundwater." <br /> "They can only meet 3'."
