MINUTES March 26, 1998 2 BOARD OF HEALTH <br /> Mr. Doherty stated, "Usually, when an applicant requests variance relief there has <br /> to be some reason." "No offer has been made to try to mitigate the effects of the effluent <br /> on the groundwater." "If I was sure this was going out into the sound it would not be an <br /> issue as obviously, the sound is going to flush." "I believe this is in close proximity to <br /> Dean's Pond." "You'll have to prove to me which way the effluent is going to go." <br /> "That's going to be the issue." "I understand the physical constraints of the lot." "If you <br /> can prove to me it flows to the sound I'll approve it however, if it flows towards the pond <br /> you or your client has to offer some type of mitigation, either in the form of a <br /> denitrification unit or some other alternative." <br /> Mr. Sanicki stated, "As long as this is a seasonal home the denitrification unit <br /> won't work properly." "What I would suggest is as this is seasonal the Board grant the <br /> variances and stipulate, with a copy filed at the Registry of Deeds, if in the event this <br /> house goes to a full-time usage at that time a denitrification unit shall be installed." <br /> Mr. Doherty commented, "Once a functional system is in there, I think it would be <br /> hard-pressed for this Board to enforce a denitrification unit." <br /> Mr. Cram commented, "Title V does not differentiate between seasonal and year- <br /> round usage." <br /> Mr. Ball relayed, "The Board could discuss the possibility of a I' mounded <br /> system." <br /> Mr. McQuaid stated, "The Board has not allowed mounded systems for new <br /> construction." "I don't think it would be to expensive for the homeowner to hire a <br /> hydrogeologist to give us the groundwater flow direction." <br /> Mr. Cram motioned to grant a 5' sideline variance, a 2' variance from the <br /> proposed leaching facility to the foundation and a I' variance from the regulation which <br /> requires 4' of naturally occurring permeable soil between the bottom of the leaching <br /> facility and groundwater with the stipulation the owner retain a hydrogeologist to submit <br /> in writing to this Board that the groundwater flow is towards Nantucket Sound, should <br /> the hydrogeologist determine the flow is towards Dean's Pond a I' mounded leaching <br /> facility will be permitted, Mr. Doherty seconded, all agreed. <br /> APPOINTMENT: Ronald Williams - Illegal Dumping <br /> Mr. Ronald Williams was in attendance for this scheduled appointment. <br />
