We probably would have done <br /> everything we could to encourage it. What the outcome would have been, if he met the <br /> requirements of Title V and he had to put in the required reserve area, and he didn't <br /> have to do the denite then he didn't have to do the denite. Would we have maybe <br /> thrown the same offer out on the table? Put in a denite and well waive the reserve? <br /> Possibly. Possibly. It's speculation at best at this point. The only thing that I can say <br /> factually is that because the regulation was not in place, we could not have required <br /> it, but we would have encouraged it." <br /> Mr. Dennis Mahoney stated, "We have some extreme concerns. First of all, I'm going <br /> to explain something clearly. There is no question in my mind, there shouldn't be any <br /> question in anybody's mind here and I don't believe that there is. We approached the <br /> town, worked with the town for a good nine months. We met formally and informally <br /> in front of all of the Boards. The Town of Mashpee has been supportive of our project. <br /> Our attorney, Kevin Kirrane, has worked with the Town. Our architect, Tony <br /> Ferragamo, has worked with the town. We've worked with Elias and presented him <br /> with certain facts. We went through all of the different stages even before we went <br /> forward to develop a plan and a building permit. The only issue I'm going to discuss <br /> right now is our intent. Our intent clearly, paper trail, our engineer Steve Haas, <br /> Elias... I've met with you gentlemen informally, we've never really had any definite <br /> conversations... our intention clearly, clearly was a reserve and a Title V, period. Our <br /> paperwork indicates that. Our correspondence indicates that and our permits <br /> purchased indicates that. Denitrification system, no thank you. We are a non-profit. <br /> We are not a for-profit. We're not a 99 Restaurant who's going to a quid pro quo to <br /> gain something financially. We do not gain anything from this. If we were for profit <br /> and if we were going into business and had the opportunity to offer something... I'll <br /> give you something and you give me some parking spaces...Or I'll give you this and <br /> you give me a smaller grease trap... That's not what we're about or what we do. <br /> Period. I have met with the Cape Cod Commission twice. I'm very concerned right <br /> now over the actions of the Cape Cod Commission who's requiring of all of this, the <br /> outcome with the Talanian people and the Life program. They have been extremely <br /> good to us. This town has been wonderful to us. We've worked in other towns. If they <br /> pull out, if they impose restrictions on us, if you people now impose that we do <br /> denitrification system, that cost is tremendous. We have pavement down, we could <br /> not go back and do Title V's. In two meetings with the Cape Cod Commission I spoke <br /> at both of them. One of them we urged the fact that we were going to go forward with <br /> this and that we would need some time. We gave everybody a timeframe on this. I've <br /> had several meetings with Brian Dudley. One of the last meetings I had with him I <br /> said "you tell me in three weeks what I'm going to do because this is what I intend to <br /> do." My intention is reserve, Title V on my plans, nothing else. We were ready to go <br /> forward with that. We were in the process of ordering the material to go in the ground. <br /> I appeared in front of you gentlemen one afternoon, that was probably a year ago in <br /> June, when they had the boat there, and I said the same thing at the time. It should <br /> not have been a surprise to the Cape Cod Commission. I've had little dealings with <br /> you. It concerns both us of extremely right now of what this impact is going to have <br /> on our project. And what I said at the time is, either Title V, which was acceptable to <br /> us, or if you were going to allow us to go with the Talanian project, that was a win-win <br /> situation for everybody. It helped us out financially, which is of concern to us because <br /> we are a non-profit. It also helped out the groundwater. That would have taken <br />
