We gave, and I don't mean to say ultimatums, but at that time we said <br /> okay this is what we need to do. I need to know by this time. The Cape Cod <br /> Commission has been extremely kind to us and I'm not angry or upset with them, but <br /> we are extremely concerned III tell you. At that time you allowed phase 1, phase 2 to <br /> happen. Right there is an indication you knew our intention." <br /> Mr. Eichner stated, "I think at that point,just as a way of explanation, at that point <br /> there was a desire to be accommodating to you and..." <br /> Mr. Mahoney interjected, "And we appreciate it." <br /> Mr. Eichner continued, "... and I understand your concerns and I think the <br /> Commission met those concerns and allowed that to go forward. I will say that in <br /> making that decision that does not represent any sort of approval of the Talanian <br /> project. It just represents that there was a desire here to move forward on that <br /> particular part." <br /> Mr. Mahoney added, "The point which I'm trying to make in that statement isn't the <br /> desire for Talanian to go forward or not to go forward, but I think it's the point that <br /> they clearly understood our intention. Our intention at the time was Title V, reserve. <br /> So, I mean I heard you make the statement that... this was a surprise... and I <br /> apologize for that, but our statement has been very clear and our mission has been <br /> clear." <br /> Mr. Eichner stated, "I think you misunderstood me." <br /> Mr. Mahoney stated, "That's possible." <br /> Mr. Eichner continued, "It was a surprise to us during the hearings, I mean we had <br /> been progressing along under the consideration that it was going to be Title V and it <br /> was a surprise to us at the hearings to have minutes brought forward saying that <br /> there was an understanding with the Board of Health that if this didn't go forward it <br /> was going to be a denitrifying system." <br /> Mr. Mahoney add, "See, that was maybe something that they would like. If I were to <br /> give them that, what were they going to give me?" <br /> Mr. Eichner responded, "I understand your situation. I hope you understand my <br /> situation." <br /> Mr. Mahoney continued, "Believe me, I'm trying to and I'm not being critical of the <br /> Cape Cod Commission because, in fact, they were helpful in doing this. Our extreme <br /> concern right now would not have brought us further discussion with the Talanian <br /> people. We have talked to our own people though, is what ramification your imposing <br /> upon them at the 11th hour. That's going to have a tremendous financial impact on us <br /> and we're concerned about that." <br /> Mr. Ball questioned, "Is your full intent to hook into the Talanian when it becomes <br /> available?" <br />
