MINUTES May 10, 2001 2 BOARD OF HEALTH <br /> 3. Perk extension request- 75 West Way <br /> Cape & Islands Engineering submitted a request for a 6-month extension to the <br /> percolation test performed at 75 West Way which is due to expire on May 21, 2001. <br /> The delay is due to the New Seabury Architectural Review Committee's approval <br /> process. <br /> Mr. Doherty motioned to grant a 6-month extension to the percolation test at 75 <br /> West Way in Mashpee. Mr. Santos seconded the motion. Motion passed. <br /> APPOINTMENT: Maria Correia re: request for food establishment permit <br /> Ms. Maria Correia of Dunkin Donuts was in attendance for this scheduled <br /> appointment. <br /> Ms. Correia stated that last July her father, Amos Correia owner of Dunkin Donuts, <br /> send a letter to the landlord of their current store at John's Pond Center asking to <br /> negotiate a lease for the upcoming year. The landlord responded in November by <br /> raising the rent three times what they were currently paying. This gave the Correia's <br /> only a very short time to decide what to do and to vacate the premises due to the <br /> exorbitant rent increase. <br /> Mr. Doherty stated that his concern was that one day the establishment was open and <br /> a few days later it was closed with no notice to the Board of Health. This could be <br /> construed as abandonment of their license. <br /> Ms. Correia stated that she had no idea that she had to notify the Board of Health and <br /> didn't know the procedures. She apologized to the Board members. <br /> Mr. Doherty motioned to approve a new food service establishment permit to Dunkin <br /> Donuts in Brickyard Marketplace pending a pre-opening inspection. Mr. Santos <br /> seconded the motion. Motion passed. <br /> 4. Report from CCRTCP re: tobacco compliance check <br /> Ms. Warden informed Board members that the Cape Cod Regional Tobacco Control <br /> Program had conducted a compliance check in Mashpee on April 25, 2001 of <br /> tobacco retailers. The following retailers sold cigarettes to a minor during this <br /> compliance check: Star Market, Mobil "On the Run" and Mike's Service Station. <br /> Ms. Warden informed Board members that it was the 3rd violation for each Star <br /> Market and the Mobil Station and the 2nd violation for Mike's Service Station. <br /> Discussion took place regarding what appropriate action should be taken by the <br /> Board of Health. <br /> Mr. Santos motioned to revoke the Tobacco Sales license for Mobil "On the Run" for <br /> 60 days from the receipt of the certified letter notifying them of this action, to fine <br /> Star Market $300.00 and fine Mike's Service Station $100.00. Mr. Doherty <br /> seconded the motion. Motion passed. <br />
