MINUTES May 10, 2001 3 BOARD OF HEALTH <br /> 5. FYI: Cape Cod Commission Public Hearing 5/5/01 6:30 p.m. Town Hall re: <br /> Jurisdictional Determination New Seabury Development Project <br /> Board acknowledged. <br /> 6. Request for Food Establishment Permit- Morning Glories Food d/b/a Country <br /> Store and "Cafe Twiggs" (both at Popponesset Marketplace) <br /> Mr. Santos motioned to grant Retail Food and Food Establishment permits to <br /> Morning Glories Food. Mr. Doherty seconded the motion. Motion passed. <br /> Mr. Santos motioned to grant a Seasonal Food Service Establishment permit to <br /> "Cafe Twiggs". Mr. Doherty seconded the motion. Motion passed. <br /> APPOINTMENT: Joseph Harvey re: request for waiver of perk tests <br /> Mr. Joseph Harvey was in attendance for this scheduled appointment. <br /> Mr. Harvey stated that his office is involved with the design of the upgrade/repair of <br /> existing septic systems located at Cape Cod Holiday Estates. Only one unit is to be <br /> repaired at this time, however there are 30 +/- units that will each require an <br /> upgrade/repair in the future. Mr. Harvey is requesting that he be allowed to prepare <br /> new plans using the original percolation test results, which indicate medium sands <br /> with a perc rate of less than 2 minutes per inch. The repair plan would indicate that a <br /> new soil evaluation would be performed at the time of installation, with the Health <br /> Agent present. <br /> Mr. Doherty motioned to waive the percolation tests for the repairs/upgrades to the <br /> septic systems at Cape Cod Holiday Estates with the stipulation that a Health Agent <br /> witness the soils at the time of installation. Mr. Santos seconded the motion. Motion <br /> passed. <br /> 7. Complaint re: Aqua Jet of Today <br /> Mr. Doherty stepped down from discussion on this matter. <br /> Ms. Warden presented Board members with a letter of complaint against licensed <br /> well driller Aqua Jet of Today. She further stated that Mr. Michael DiMaggio <br /> (owner of Aqua Jet) does not pull any repair or irrigation well permits which are <br /> required by the Board of Health. He has a history of failing to obtain necessary <br /> permits. <br /> Discussion took place regarding what appropriate action the Board of Health <br /> should take on this matter. <br /> Mr. Santos motioned to suspend the well drilling license to Mr. Michael DiMaggio, <br /> owner of Aqua Jet of Today, for 60 days from the receipt of the suspension letter <br /> and forward a copy of the letter to the Department of Environmental Management. <br /> Mr. DiMaggio will also be given the opportunity to come before the Board. Mr. Ball <br /> seconded the motion. Motion passed. <br /> 8. FYI: Luna Cancer Inv. Meeting Thursday May 17 2001 6:00 p.m. Barnstable <br /> Superior Courthouse <br /> Board acknowledged. <br />
