Variance request: 202 Daniel's Island Road
The applicant is requested a variance from 310 CMR 15.211 setback distances. The
proposed soil absorption system will be 3' off the street property line.
Discussion took place regarding the plans submitted and the Board's concerns over the
fact that originally it was a three-bedroom home. The applicant had combined all of the
lots and because it was pre-existing non-conforming they had up until 1995 to meet all
of the regulations. It is a 34,000-sq. ft. lot. He originally wanted four bedrooms and
now he wants five. He already has permission for four bedrooms. If it goes to five
bedrooms at 10,000-sq. ft. per bedroom he should have a 50,000-sq. ft. lot. He meets
the 100' requirement from the marsh to the reserve area.
Mr. Doherty Stated, "That because of the sensitivity of the applicants area the Board of
Health will not be granting any variances without consideration of the area." He also
recommended the engineer inform the owner that the Board is not inclined to vote
favorably with the increase in the number of bedrooms without the installation of a
denitrification unit.
Mr. Ball motioned to deny the variance request. Mr. Santos seconded the motion.
Motions to deny passed.
