TOWN OF MASHPEE <br /> BOARD OF HEALTH <br /> August 2, 2001 <br /> Meeting was called to order at 7:03 p.m. <br /> Members present: John T. Doherty, L. Glenn Santos, Steven R. Ball, and Veronica A. <br /> Warden <br /> Mr. John T. Doherty, Chairman <br /> 1. Sign warrants. Warrants Signed <br /> 2. Approve minutes of July 5th & 19, 2001. <br /> Mr. Doherty motioned to approve the minutes of July 5t", 2001. <br /> Mr. Santos had a question regarding page four paragraph thirteen. He wanted to make <br /> certain that the BOH stays consistent with what they had ruled earlier regarding the use of <br /> either manual or electronic means of accurately identifying customers' ages per their <br /> previous letter to the Mobil "On The Run" tobacco retailer. Mr. Santos understood that <br /> their decision was to keep it an electronic scanning process. <br /> Mr. Doherty stated that the word manual was input because the Mobil "On The Run" <br /> management was saying that the BOH had said that they were to specifically use that <br /> machine. When, in reality it was their policy to use the scanning machine to eliminate the <br /> need to mathematically calculate the peoples' ages from their licenses. The word"manual" <br /> means that the Mobil "On The Run"personnel can read the license and calculate it out <br /> themselves. <br /> Mr. Santos motioned to approve the minutes of July 5th, 2001. Mr. Ball seconded the <br /> motion. Motion passed. <br /> Mr. Doherty motioned to approve the minutes of July 19th, 2001. Mr. Ball seconded the <br /> motion. Motion passed. <br /> 3. Response from John Peters regarding complaints on ancient burial site (Mizzenmast Road). <br /> Mr. Santos suggested that the BOH invite both the landowners and Mr. Peters for the next <br /> BOH meeting. His concern was that it might take another year or so to conclude <br /> negotiations regarding this site. Therefore, it might be in everyone's best interest to fence <br /> the area. <br /> Mr. Doherty was concerned with where the BOH was heading with the overall issue. Did <br /> the BOH intend to move to have the landowner secure the site or fence it oft? Did they <br /> intend to get all of the concerned parties together to come to some type of agreement to <br /> rectify the situation? He was sensitive to having a meeting without having a clear purpose. <br /> Mr. Santos felt that the responsibility rests with the landlord. <br /> Mr. Ball suggested that they copy Mr. Peters'response letter to the Little Neck Bay <br /> Association and see what type of response they receive. <br /> The discussion continued amongst the Board members regarding whether or not there <br /> actually was a public health hazard and if there was any real jurisdiction. It was <br /> determined that there really was no public health hazard just the neighbors' complaints <br />
