He wasn't sure if they were still active. It was an <br /> open hole that you can walk into. It was banked and you wouldn't necessarily fall into it. <br /> Mr. Santos felt that the fox families wouldn't be there if the site hadn't been dug up and left <br /> the way it was. <br /> Mr. Doherty felt that the foxes would naturally occur regardless of the site. <br /> Mr. Ball felt that the homeowners association should request that animal control remove <br /> them. <br /> Mr. Santos said that there was a law in place that states that animal control cannot remove <br /> them from their natural habitat unless they are rabid and/or pose a threat to the public <br /> wellbeing. <br /> Mr. Ball reiterated that he wasn't talking about Mashpee Animal Control but a professional <br /> wildlife management company.They specialize in professional animal removal. The <br /> Association can do that legally. <br /> Mr. Doherty asked what is the impetus to do that? He stated that assuming that they are <br /> not rabid what is the reason that they should be removed. <br /> After further discussion it was determined that the BOH's action would be to copy John <br /> Peters' letter to the Little Neck Bay Association president, Jimmy Vacarro, in response to <br /> the homeowners complaints regarding the fox population. It was also decided that BOH <br /> would send a memo to the Building Department along with a copy of John Peter's letter <br /> advising them of the current status of the situation. The letter from the BOH to Mr. Vacarro <br /> would also mention that the BOH was bringing this situation to the attention of the <br /> Building Department. However, due to the assumption that the issue of the burial site was <br /> soon to be resolved by all interested parties per Mr. Peters' letter to the BOH dated July <br /> 13w, 2001, there would be no further action on the BOH's part. The BOH would keep the <br /> Little Neck Association updated on any further developments as they arise. <br /> 4. Request for 2001 Food Establishment Permit •- Southport Condominium Association <br /> Discussion took place regarding the completion of Southport's kitchen. Ms. Warden stated <br /> that there would be no actual cooking on the premises. Ms. Warden said that the situation <br /> was the same as the one given to Christ the King Church.You have charitable events that <br /> will be catered by outside vendors. There is no actual "staff'hired to run the kitchen. Ms. <br /> Warden conferred with retired Town of Mashpee health agent, Orin Evans, and he agreed <br /> with her that it was the same situation as the church. Furthermore, everything meets the <br /> requirements except one thing, the mop closet. They don't really have one so they <br /> designated a small area that will be an add-on to the kitchen facility. They are going to <br /> build a room. They are required to have the "mop closet" completed by October 16t, 2001. <br /> Ms. Warden asked the BOH members that if they are inclined to grant the permit would <br /> they also stipulate that the mop closet be completed by the deadline given. <br />
