Variance request: 39 Little Neck Road
The applicant is requesting a variance from 5.405 (la): reduction in setback, 4.5' from
leaching facility to property line and 5'from septic tank to property line and a 29'reduction
in setback to coastal bank. The property line variances are also requested under the
Mashpee Health Regulation 3.7. Also requested under Mashpee Regulations is a reduction
in setback, leaching facility to the coastal bank of 79' and to the wetland of 17'.
Ms. Warden did speak to Ms. Diane Baretos of Conservation about this particular request.
At the time she knew nothing about it subsequently, a note was left indicating that she
went over to view the site with no further comment. Ms. Warden's concern was why the
engineer did not move this up to the street line in order to obtain another ten feet. Ms.
Warden answered her own question by recalling that power lines that limit the engineer's
choice of placement surround the lot.
Mr. Doherty confirmed that they had a denitrification unit system in the plans as well as
the necessary 80'. Therefore, they met the requirements.
Mr. Ball motioned to grant the variances requested. Mr. Doherty seconded the motion.
