t
•IAetlMark Project(continued)
Tom O'Hara stated he asked a landscape architect and others for input and as a result of various visits to the site the
following were noted:
• Concrete retainer wall never showed on plan but now it exists.
• Stone wall is not as it appears on the Plan.
• Issue with grading. Tom Fudala showed the Plans that were approved. Tom O'Hara said they changed building
so that side of building is not acting as retaining wall as planned. Steven Hayessaid client wanted change so they
made change. He said it was a field decision to get better windows.
• Landscaper Tom Jawloy told Tom O'Hara that he feels confident the pine tree should stay and would seek
opinion of arborist. Kevin Kirrane said if tree is to stay he writs it on the record because they feel it is unsafe.
Steven said they had an arborist look at it and their arborist said it is unsafe.
• Tom O'Hara asked: Where did the basement come from? Steven said it's only being used for storage for
equipment and sprinkler mains. Steven said this is the most cost-effective way to sprinkle the building, but no
sprinklers are in the basement storage area, only used for storage.
• Steven Hayes agreed that what's out there is not the same as the plan. He said they had to excavate 7 feet lower.
• Tom O'Hara pointed out that they changed the design of the stone wall at the comer and didn't carry the character
of the stone wall at all. Steven said he agreed the comer needs some work and he noted it doesn't match.
• Steven Hayes marked his plans and said he will check and make sure plans are accurate.
• Lee Gurney pointed out that there is a major issue here—that is,not working within approved plans.
• Kevin pointed out that it is a difficult site because it was a gravel pit 40 years ago.
• Tom Fudala noted that the Plans approved by the Planning Board with conditions that have not been done and 4
months have passed. Tom Fudala said they never submitted the engineering plans that they were supposed to
submit. They said they would do this.
• Tom Fudala said his opinion is build to original plans. He suggested doing something to work around the
situation. He is in favor of taking the pine tree down. He said keep the buffer and keep the walls. Charlie
Rowley added a comment that you can't build a stone wall that is 6 feet so it would be an engineered wall.
Charlie said there are some engineered walls that look nice...they look like stone.
• Steven said he would make sure he comes back with Plan that shows actual site plan. Charlie said to include
actual site grades in the Plan.
Conclusion: If opinion of Applicant's arborist is that the pine tree is unsafe then remove it but it should be
replaced with something. Design Review Committee voted 2 to 1 to keep 10' buffer. The corner retaining wall to
match the stone wall. Issue: Not building to original plans. Tom Fudala said Planning Board approved with
conditions that have not been met. They will provide engineering plans to Planning Department.
Tom Fudala and Charlie Rowley exited the meeting.
Approval of Minutes
Minutes of October 12,2006 were approved.
Discussion
The Committee expressed sympathy at the untimely passing of Kathleen Eynon, who had just recently been appointed to
serve on this Committee.
Tom O'Hara advised that Tom Jawloy, a landscape architect, has submitted his resume to the Board of Selectmen
requesting to be appointed as a member of the Design Review Committee.
Adjournment...Meeting was adjourned at 10:15 a.m.
Respectfully submitted,
J q=Lerti/
R rding Secretary
