The Committee reviewed the proposed June 2, 2009 Plot Plan; the Board of Health recommended <br /> changes; and Plan Review Committee proposed kennel conditions and changes. The highlights of <br /> the discussion of the kennel conditions and changes are noted below. <br /> Fencin <br /> • Chain link fencing to be 6 feet, not 5 feet as shown on Plot Plan. Plot Plan to be revised. <br /> • A 6 foot chain link fence placed on a concrete footing shall separate the kennel area from the <br /> remainder of the back yard and shall also be installed surrounding the kennel building at <br /> approximately 12 feet from the building, with all fencing to be erected as shown on the site <br /> plan entitled "Proposed Kennel Plot Plan, #225 Ashumet Road in Mashpee, MA" revised date <br /> June 11, 2009. <br /> • Chain link fence to be in concrete footing. <br /> • Stockade fence to be 8 feet. Stockade fencing to be around the entire perimeter of the <br /> property, including around the kennel area. <br /> • A buried base of concrete blocks or concrete footing to be placed in front of the adjacent <br /> stockade fence so that the dogs cannot dig underneath the stockade fence to get out. Mr. <br /> Lopes said he agreed to put the concrete blocks or concrete footing all the way down the <br /> property. <br /> • Mr. Lopes said that somebody is going to help him install the fencing. <br /> (Condition 2 to be changed to reflect these amendments.) <br /> Audience Comment: Attorney Robert Mills addressed the Hearing stating that at last night's <br /> Board of Health meeting his impression was that the Board of Health was looking for the <br /> whole kennel area be covered and that the chain link fence be curved at the top so that it <br /> would have the "suicide-type" angle. In addition, he thought he heard the Board of Health say <br /> they wanted the chain link fence to run the entire length of the stockade fence. <br /> Attorney Robert Mills also stated that MIM Shay consulted with homeowner's insurance, and <br /> Attorney Mills questioned whether the $1M-$2M insurance would be enough and asked <br /> whether Town Counsel agreed to insured amount. He was told Town Counsel did agree to the <br /> insured amount. <br /> Dogs <br /> Ronnie Warden stated that the Board of Health requires that no more than 2 dogs are to be out of the <br /> kennel,at one time and must have one of the kennel license owners present at all times. Ronnie <br /> explained that the reason the Board of Health wants the 2 dogs out of the kennel to be personally <br /> supervised by one of the kennel license holders is because they don't want a child to be with the dogs <br /> and because of an error might leave the gate open. Mr. Lopes and his attorney expressed that this is <br /> an unnecessary hardship; that in 6 years his dogs have been around people without any incident. <br /> Accordingly it was agreed that no more than 2 dogs would be allowed in the stockade area unless <br /> they are under the personal supervision of a kennel license holder or the kennel license holder's son, <br /> Quentin, or the kennel license holder's aunt, Lynette Hill. <br /> (To be added to kennel condition list.) <br /> 2 <br />
