The Moderator read Article 25 <br /> Article 25. <br /> To see if the town will vote to amend Section 4. 7. 5 of the <br /> Town By-Laws by replacing subsection d. with the following: <br /> "d. All water skiing is subject to the applicable <br /> provisions of the General Laws of the Commonwealth, <br /> as amended, and to the further restriction that nn <br /> water skiing, jet skiing, motor or propelled surfboards <br /> Ir or water bikes, are to be operated in or on the fresh <br /> and salt waterways of Mashpee before the hour of 10:00 <br /> a.m. and after the hour of 6 :00 p.m. " , or take any action <br /> relating thereto. <br /> Donald Lund: I am a member of the Waterways Commission and a <br /> Waterways Special Police officer. I move this Article as printed <br /> excepting the phrase`or take any action relating thereto." <br /> Motion seconded. <br /> Voter: Why? <br /> Mr Lund: We have given the best hours to the water skier . This is the <br /> feeling of the Waterways Commission. We also feel that the fellow who <br /> wants to fish at night has some rights. A half hour before sunset is <br /> almost impossible to enforce; everybodys' watch is different and it <br /> naturally changes everyday. We feel everybody has their rights;including <br /> the person who wants to sit on their porch and have a little peace end <br /> quiet. <br /> Voter: Sir, I work from 8 to 6. <br /> Mr Lund: That is why it is seven days a week <br /> Voter: I, also work from 8 A.M. to 6 P.M. I feel this is going to cut <br /> down on my enjoyment. I just bought a house on Mashpee Lake for the <br /> purpose of water-skiing. I water-ski in November and in April and it <br /> is dark at 6P.M. . . I think a half hour before sunset is better. <br /> Mr Benway: In Popponesset Bay and Waquoit Bay; Will we share joint <br /> jurisdiction ? If this passes, how do you propose to enforce such <br /> a bylaw? <br /> DIr Lund: It will be a problem;but at least we can enforce it. . .we <br /> can not enforce it at all now. The biggest offenders are Waquoit Bay <br /> and especially Popponesset. We are a non paid Board and we are trying to <br /> do the best for Mashpee. This is a big safety reason for them. It gets <br /> later and the people do not listen; somebody could get hurt. I am sorry <br /> that there will be some hurt in that they can not get in as much skiing <br /> as possible but we have to do our best. <br /> Mrs Muse: I do not water ski, jet ski oP surf; but I think this is too <br /> restrictive. <br /> Mr Benway: I would like to step down as Moderator and make a statement, <br /> also. I know a lot of 16. . .17 year olds who ski and they work in rest- <br /> aurants all summer long and get home around five or. six. <br /> When they do go out to ski after six, its the time the bathers are not <br /> out there. There is not the conflict at these hours as during the day. <br /> I think that Zo say to a kid wather he is a tourist;renting or if he <br /> lives here that you can not ski legally on any waterway between six <br /> and eight o' clock is just not justice. How are we going to decide <br /> who is in the middle of Popponesst or Waquoit Bay? I' think we are <br /> creating an awful bag of worms and. it is going to be an awful job for <br /> Mr Lund and his group. <br /> Mr Lund: How do we do it at "yen in the morning? . How about the man who <br /> fishes? <br />
