<br /> Explanation: This article would authorize the Board of Selectmen to purchase, on
<br /> behalf of the Conservation Commission, all or a portion of 21 lots and adjacent"open
<br /> space" lands in the"Willowbend"subdivision which include the mouth of Quaker Run
<br /> and a high bluff above Shoestring Bay. The land contains known archaeological
<br /> resources in addition to its beauty, habitat value and passive recreation opportunities.

<br /> To see if the Town will vote to authorize the Board of Selectmen to petition the General
<br /> Court for special legislation authorizing the Town to enter into a land exchange with
<br /> First American Bank in which the Town would transfer to the Bank the land shown on
<br /> Assessors MP

<br /> and the Bank would transfer to the Town all or a portion
<br /> of the land shown on Assessors' Map 94 as Blocks 6, 7 and 8, or take any other action
<br /> relating thereto.

<br /> Explanation: This article seeks to approve a land exchange between the Town and
<br /> a' Southcape Resorts. Through this exchange, Southcape Resorts would receive a parcel
<br /> of land containing their parking lot, which was taken for non-payment of taxes. In
<br /> return the Town would receive valuable conservation land.

<br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or
<br /> otherwise, for conservation purposes, all or a portion of those parcels of land identified
<br /> on the 1998 Mashpee Assessors' Maps as Map 70, Blocks 24, 25, 26, 27, 28, 29, 30, 31,
<br /> 32, 33, 34, 35, 36, and 37, Map 70, Blocks 8, 10, 12, 14, 20, 22, 98, 102, 107, 108,
<br /> 126 13
<br /> 0 137 138 and 140 and Map 77, Blocks 1, 4, 9, 11

<br /> and 13, located between the Santuit River, Maushop Stables, the Willowbend
<br /> development, and Cotuit Bay Condominiums off Quinaquisset Avenue, to be held in the
<br /> care and custody of the Conservation Commission pursuant to Massachusetts General
<br /> Laws Chapter 40, Section 8C; and further, to see if the Town will vote to raise and
<br /> appropriate, or transfer from available funds, $434,000 for such purpose, including
<br /> expenses incidental and related thereto, and to raise such appropriation, the Treasurer,
<br /> with the approval of the Selectmen, be authorized to borrow $434,000 or any other sum
<br /> under and pursuant to Chapter 44, Sections 7 and 8C and, if applicable, Chapter 40,
<br /> section 8C of the General laws, or any other enabling authority, and to issue bonds or
<br /> notes of the Town therefor and to designate said land as an open space land acquisition
<br /> pursuant to the Cape Cod Open Space Land Acquisition Program established by Chapter
<br /> 293 of the Acts of 1998 so as to permit said borrowing to be repaid with funds from the
<br /> land bank fund established by the Town under the provisions of Chapter 293, and
<br /> further, to see if the Town will vote to raise and appropriate or transfer from available
<br /> funds $2500 to the Issuance of Debt Account; and further, to see if the Town will
<br /> authorize the Board of Selectmen and / or Conservation Commission, with the approval
