Subsequent to the land takings, four legal actions were commenced in <br /> Barnstable Superior Court seeking assessment of further damages with respect to said land <br /> takings. The proposed supplemental appropriation will be utilized to effect a settlement of the <br /> last two pending land damage cases, which are scheduled for trial in July 2000. The principal <br /> and interest payments for the supplemental appropriation will be excluded from the calculation <br /> of the Town's levy limit in the same manner as other Mashpee High School capital costs <br /> pursuant to the debt exclusion referendum passed by the Town for this project in 1993. <br /> Recommendation: The Finance Committee recommends approval. <br /> Motion made by Selectman Blythe. <br /> Motion: I move the Town hereby appropriate the sum of $850,000 to pay additional costs <br /> related to the acquisition of land for the new Mashpee High School, including appraisals and <br /> other costs incidental or related thereto, and that to meet this appropriation, the Treasurer, with <br /> the approval of the Selectmen, is hereby authorized to borrow said amount under and pursuant to <br /> Chapter 44, Section 7(3) of the General Laws, Chapter 645 of the Massachusetts Acts of 1948, as <br /> amended, or any other enabling authority, and to issue bonds or notes of the Town therefor. <br /> Motion passes 146-14 at 8:40 p.m. <br /> Article 25 <br /> To see if the Town will vote to authorize the Selectmen to acquire, by purchase or otherwise, all <br /> or a portion of a parcel of land of 30 acres, more or less, identified on the 1999 Mashpee I <br /> Assessors' Maps as Map 36, Block 35, also shown as Parcel 2 on a "Plan of Land in Central <br /> Mashpee Mass. for Harry W. & Ellen A. Tabb", dated September 3, 1969 by Charles N. Savery, <br /> Inc., with the portion of said land lying east of a line 25 feet east of the center line of <br /> Goodspeed's Meeting House Road, excluding any land lying within 25 feet on either side of the <br /> center line of Noisy Hole Road, to be held for conservation and passive recreation purposes in <br /> the care and custody of the Conservation Commission pursuant to Massachusetts General Laws <br /> Chapter 40, Section 8C, the portion lying west of a line 25 feet west of the center line of <br /> Goodspeed's Meeting House Road to be held for open space or recreation purposes in the care <br /> and custody of the Board of Selectmen and the remainder to be held in the care and custody of <br /> the Board of Selectmen for general municipal purposes, including roadway use; and further, to <br /> see if the Town will vote to raise and appropriate, or transfer from available funds, $330,000 for <br /> such purpose, including expenses incidental and related thereto, and to raise such appropriation, <br /> the Treasurer, with the approval of the Selectmen, be authorized to accept donations and be <br /> further authorized to borrow $330,000 or any other sum under and pursuant to Chapter 44, <br /> Sections 7 and 8C and, if applicable, Chapter 40, section 8C of the General laws, or any other <br /> enabling authority, and to issue bonds or notes of the Town therefor; with all but one dollar <br /> ($1.00) of said borrowing to be repaid with funds from the Land Bank Fund established by the <br /> Town under the provisions of Chapter 293 of the Acts of 1998 (An Act Relative to the <br /> Establishment of the Cape Cod Open Space Land Acquisition Program); and to designate said <br /> land as an open space land acquisition pursuant to said Chapter 293; and further, to see if the <br /> Town will vote to raise and appropriate or transfer from available funds $1,500 to the Issuance of <br /> Debt Account; and further, to see if the Town will authorize the Board of Selectmen and / or <br /> Conservation Commission to apply for and accept Federal, State and / or County grants, <br /> t <br />
