i <br /> I <br /> including reimbursement under Chapter 132A, Section 11 of the General Laws, the "Self-Help <br /> Act", to be applied by the Town toward the financing of this purchase, and to enter into contracts <br /> or agreements with Federal, State and / or County agencies, private conservation trusts or other <br /> entities or persons in connection with the purchase of such land and the preservation of those <br /> portions noted above for conservation and recreation purposes, including enforcement of <br /> conservation restrictions on the land; and finally, to see if the Town will authorize the <br /> Conservation Commission and the Board of Selectmen to enter into agreements and execute any <br /> and all instruments as may be necessary on behalf of the Town to effectuate said acquisition, <br /> sale, transfer or preservation; or take any other action relating thereto. <br /> Submitted by the Open Space Committee <br /> Explanation: This article would authorize purchase of 30 acres of land along Goodspeed's <br /> Meeting House Road, between Meetinghouse Road and Main Street, with that portion east of the <br /> road reserved as conservation land and that portion west of the road reserved for potential <br /> recreation use in conjunction with a proposed school site and a 50 foot wide strip along <br /> Goodspeed's and Noisy Hole Roads reserved for possible roadway use if ever needed. All but <br /> $1.00 of the purchase (for the roadway portion) is to be funded through the Town's Land Bank <br /> funds. The Town will also apply for 52% state reimbursement under the state's "Self-Help" <br /> program for the portion to be held for conservation purposes. <br /> Motion made by Selectman Leveille. <br /> Motion: I move the Town hereby authorize the Selectmen to acquire, by purchase or otherwise, <br /> all or a portion of a parcel of land of 30 acres, more or less, identified on the 1999 Mashpee <br /> Assessors' Maps as Map 36, Block 35, also shown as Parcel 2 on a "Plan of Land in Central <br /> Mashpee Mass. For Harry W. & Ellen A. Tabb", dated September 3, 1969 by Charles N. Savery, <br /> Inc., with the portion of said land lying wast of a line 25 feet east of the center line of <br /> Goodspeed's Meeting House Road, excluding any land lying within 25 feet on either side of the <br /> center line of Noisy Hole Road, to be held for conservation and passive recreation purposes in <br /> the care and custody of the Conservation Commission pursuant to Massachusetts General Laws <br /> Chapter 40, Section 8C, the portion lying west of a line 25 feet west of the center line of <br /> Goodspeed's Meeting House Road to be held for open space or recreation purposes in the care <br /> and custody of the Board of Selectmen and the remainder to beheld in the care and custody of the <br /> Board of Selectmen for general municipal purposes, including roadway use; that the sum of <br /> $330,000 is hereby appropriated for such purpose, including all expenses incidental and related <br /> thereto; that to raise this appropriation, the Treasurer, with the approval of the Selectmen, is <br /> hereby authorized to borrow $330,000 or any other sum under and pursuant to Chapter 44, <br /> Section 7(3) or any other enabling authority, and to issue bonds or notes of the Town therefor,; <br /> that while any borrowing authorized hereunder shall constitute a general obligation of the Town, <br /> it is expected that all but one dollar($1.00) of said borrowing shall be repaid with funds from the <br /> Land Bank Fund established by the Town under the provisions of Chapter 293 of the Acts of <br /> 1998 (An Act Relative to the Establishment of the Cape Cod Open Space Land Acquisition <br /> Program); that the Town hereby appropriates the additional sum of$1,500 from the Land Bank <br /> Account to the Issuance of Debt Account; that the Town hereby authorizes the Board of <br /> Selectmen and/or Conservation Commission to apply for and accept any available Federal, State <br /> and/or County grants, including reimbursements under Chapter 132A, Section 11 of the General <br /> Laws, the "Self-Help Act", to be applied by the Town toward the costs of this purchase, and to <br /> i <br /> 4 <br />
