i <br /> r , <br /> Motion to dispense with reading of Article 27 passes 9:16 p.m. <br /> Motion passes unanimously at 9:20 p.m. <br /> Article 28 <br /> To see if the Town will vote to authorize the Board of Selectmen to transfer five parcels of land, <br /> being shown on the 1999 Mashpee Assessors' Maps as Map 28, Blocks 77 and 78, located on <br /> Sandy Fox Drive, and Map 71, Blocks 142, 143 and 144, located on Dixon Road, for no <br /> consideration to Habitat for Humanity of Cape Cod, Inc. for the construction on such land, under <br /> the "Local Initiative Program", of five single family homes for sale to persons of low or very low <br /> income within the meaning of the Housing Act of 1937, and qualifying for listing in the <br /> affordable housing inventory maintained by the Mass. Housing Appeals Board under G.L. <br /> Chapter 40B, with such transfer to be made subject to a deed restriction, which may contain a <br /> reverter clause, permanently restricting the sale or resale price of said homes to no more than <br /> that considered affordable for persons of low income as defined by the U.S. Dept. of Housing & <br /> Urban Development and qualified for continued listing in the above affordable housing <br /> inventory; and further, to authorize the Board of Selectmen to record a permanent deed <br /> restriction prohibiting future construction on that parcel shown on said Assessors' Maps as Map <br /> 28, Block 88 in conjunction with the preparation of a "Nitrogen Aggregation Plan" regarding the <br /> above described land shown as Map 28, Blocks 77 and 78; and further, vote to authorize the <br /> Board of Selectmen to petition the General Court for special legislation authorizing such transfer <br /> and restrictions, to make use of other agencies and instrumentalities of the Town, including but <br /> not limited to the Mashpee Housing Authority, and to enter into any agreements necessary, to <br /> effect the transfer of such land in accordance with this Article, or take any other action relating <br /> thereto. <br /> i <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would authorize the selectmen to transfer title to five building lots, <br /> previously taken by the Town for non-payment of taxes, to Habitat for Humanity for <br /> construction of five affordable single-family homes. Two of the lots, on Sandy Fox Drive, <br /> would also benefit from a deed restriction placed on another parcel of tax-taking land which <br /> would allow the construction of three bedroom homes on each lot under new state "Title 5" <br /> regulations. <br /> Motion made by Selectman Cahalane. <br /> Motion: I move Article 28 be voted as printed in the warrant with the exception of the phrase, <br /> "or take any other action relating thereto", and to change the words Dixon Road to Dixon Drive <br /> as occurring in sentence 1. <br /> Motion made to dispense with reading of Article 28 made at 9:20 p.m. r, <br /> Motion to dispense with reading of Article 28 passes 9:20 p.m. <br /> Motion made to indefinitely postpone made at 9:29 p.m. <br />
