i r , Motion to dispense with reading of Article 27 passes 9:16 p.m. Motion passes unanimously at 9:20 p.m. Article 28 To see if the Town will vote to authorize the Board of Selectmen to transfer five parcels of land, being shown on the 1999 Mashpee Assessors' Maps as Map 28, Blocks 77 and 78, located on Sandy Fox Drive, and Map 71, Blocks 142, 143 and 144, located on Dixon Road, for no consideration to Habitat for Humanity of Cape Cod, Inc. for the construction on such land, under the "Local Initiative Program", of five single family homes for sale to persons of low or very low income within the meaning of the Housing Act of 1937, and qualifying for listing in the affordable housing inventory maintained by the Mass. Housing Appeals Board under G.L. Chapter 40B, with such transfer to be made subject to a deed restriction, which may contain a reverter clause, permanently restricting the sale or resale price of said homes to no more than that considered affordable for persons of low income as defined by the U.S. Dept. of Housing & Urban Development and qualified for continued listing in the above affordable housing inventory; and further, to authorize the Board of Selectmen to record a permanent deed restriction prohibiting future construction on that parcel shown on said Assessors' Maps as Map 28, Block 88 in conjunction with the preparation of a "Nitrogen Aggregation Plan" regarding the above described land shown as Map 28, Blocks 77 and 78; and further, vote to authorize the Board of Selectmen to petition the General Court for special legislation authorizing such transfer and restrictions, to make use of other agencies and instrumentalities of the Town, including but not limited to the Mashpee Housing Authority, and to enter into any agreements necessary, to effect the transfer of such land in accordance with this Article, or take any other action relating thereto. i Submitted by the Board of Selectmen Explanation: This article would authorize the selectmen to transfer title to five building lots, previously taken by the Town for non-payment of taxes, to Habitat for Humanity for construction of five affordable single-family homes. Two of the lots, on Sandy Fox Drive, would also benefit from a deed restriction placed on another parcel of tax-taking land which would allow the construction of three bedroom homes on each lot under new state "Title 5" regulations. Motion made by Selectman Cahalane. Motion: I move Article 28 be voted as printed in the warrant with the exception of the phrase, "or take any other action relating thereto", and to change the words Dixon Road to Dixon Drive as occurring in sentence 1.
