Be it enacted by the Senate and House of Representatives in General Court Assembly, and by the authority of the same, as follows: SECTION l: Notwithstanding the provisions of Chapter 39, Section 9 of the General Laws, or any general or special law to the contrary, the Town of Mashpee is hereby authorized to hold a Fall Annual Town Meeting. SECTION 2: This act shall take effect upon its passage, or take any other action relating thereto. Submitted by the Town Clerk k Explanation: Chapter 39, Section 9, allows a town to hold an annual town meeting to be held between February and May unless provided by special law. This article proposes a special law to formalize the Fall Annual Town Meeting. Motion made by Selectman Marsters. Motion: I move Article 30 be voted as printed in the warrant with the exception of the phrase, "or take any other action relating thereto". Motion passes at 9:42 p.m. Article 31 To see if the Town will vote to amend the Zoning By-law as follows: by replacing the definition of a"Home Occupation"in Section 174-3 with the following: "HOME OCCUPATION — Gainful employment carried on by the permanent residents of a dwelling unit. A home occupation must be clearly incidental and secondary to the use of the premises as a dwelling and compatible with surrounding uses. Home occupations do not involve the production of products where electrical interference, noise, dust, vibration, glare, fumes, odors, or other objectionable effects are perceptible outside the premises.", by replacing the current wording of Section 174-25.I(5) with the following: "(5) Permitted Home Occupations, subject to the provisions of Subsection 174-25.1.", by replacing the current wording of Section 174-25.I(6) with the following: "(6) Conditional Home Occupations, subject to the provisions of Subsection 174-25.1. by changing the designation under all columns for Subsection 174-25.I(6) from "PR"to "SP" and by adding the following new Section 174-25.1: I .
