t i
(10) Activities conducted and equipment or materials used shall not change the fire
safety or occupancy classification of the premises.
E. Uses prohibited as home occupations. The following shall be considered examples of
uses prohibited as home occupations that will not be allowed to operate in residential
zoning districts:
(1) Commercial kennels;
(2) Veterinary establishments;
(3) Dancing studios or exercise studios;
(4) Restaurants;
(5) Welding or machinist shop;
(6) Print shops;
(7) The sale of retail or wholesale merchandise from the premises;
(8) Service or repair of motor vehicles or of gasoline or diesel powered machinery;
(9) Equipment rental business.
F. Rummage / garage / yard sales are permitted as of right, provided that no more than
three (3) one-day sales per year are conducted.
or take any other action relating thereto.
Submitted by the Board of Selectmen
Explanation: This article is intended to modernize the Town's antiquated and outdated home
occupation bylaws. In an era in which government, business and society in general are
attempting to encourage home occupations to bolster family unity, reduce traffic, preserve
energy and reduce commercial development, Mashpee continues to require compliance with an
obsolete and prejudicial town bylaw. This new bylaw will allow a broader scope of occupations,
many of which already exist, by recognizing activities new technology has made possible and
acknowledging individual business opportunities not contemplated decades ago. This bylaw will
preserve traditional Cape Cod occupations and potential "Green Tourist" enterprises while
protecting the integrity of our neighborhoods and the value of our properties.
i
Planning Board voted at a Public Hearing held on April 19, 2000 3-0 for approval.
Motion made by Selectman Leveille.
Motion made to dispense with reading of Article 31 made at 9:42 p.m.
Motion to dispense with reading of Article 31 passes 9:42 P.M.
Motion: I move Article 31 be voted as printed in the warrant except for the following
amendments: 4 ;
In Subsection 174-25.1.C.(3)(b) change "two (2) additional parking spaces" in the first
sentence to "three (3) additional parking spaces" and delete the phrase "and two (2)
spaces for employees";
