-3- <br /> Article 9: To see if the District will vote to authorize and empower the Board of Water <br /> Commissioners to take by eminent domain, on behalf of the Water District for water <br /> supply purposes, an easement in, upon, over and under Miller Farm Road. Said street is <br /> shown on Town of Mashpee Assessors Map #79 and a plan entitled "Easement Plan of <br /> Land-Miller Farm Road", prepared for the Mashpee Water District, Scale t" = 40' by <br /> Christopher Costa and Associates, East Falmouth, Massachusetts, dated April 3, 2003. <br /> Copies of the Assessors map and Easement plan are on file in the office of the Mashpee <br /> Water District, 79 Industrial Drive, Mashpee, Massachusetts. Said taking to include any <br /> mains, water pipes and appurtenances lying within said way, or take any other action <br /> relating thereto. <br /> Explanation: The eminent domain taking referred to in this Article is necessary to allow <br /> the District to maintain and repair the water main installed by the developer. <br /> Article 10: To see if the District will vote to authorize and empower the Board of Water <br /> Commissioners to take by eminent domain, on behalf of the Water District for water <br /> supply purposes, an easement in, upon, over and under Palmer Road. Said street is <br /> shown on Town of Mashpee Assessors map #66 and a plan entitled "Easement Plan of <br /> Land-Palmer Road", prepared for the Mashpee Water District, Scale t" = 40' by Eagle <br /> Surveying, Inc., Yarmouthport, Massachusetts, dated October 22, 2002. Copies of the <br /> Assessors Map and Easement Plan are on file in the office of the Mashpee Water District, <br /> 79 Industrial Drive, Mashpee Massachusetts. Said taking to include any mains, water <br /> pipes and appurtenances lying within said way,or take any other action relating thereto. <br /> Explanation: The eminent domain taking referred to in this Article is necessary to allow <br /> the District to maintain and repair the water main installed by the developer. <br /> Article 11:To see if the District will vote to raise and appropriate or transfer from available <br /> funds, $50,000 for legal and appraisal costs associated with a law suit into the Legal <br /> Expense Account, or take any other action relating thereto. <br /> Explanation: This Article is necessary to fund legal and appraisal costs associated with <br /> pending litigation concerning the Mashpee Village Wellsite. <br />
