TOWN OF MASHPEE Board of Appeals Town Hall, Mashpee, Massachusetts 02649 June 23, 1976 Re: Appeal of Dynamic Action Residents Enterprise, Inc. DECISION A petition was duly filed by the petitioner for a special permit under the provisions of the zoning by-law for the Town of Mashpee, Section 6.3 B8 to operate a group home/settlement house for young people aged 14 to 18. Notice was duly given to abutters and owners of land next adjoining the land of the abutters. Notice was given by pub- lication by publishing in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee on May 25, 1976 and June 1, 1976, a copy of such notice being appended hereto. A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, June 9, 1976 at 8 :00 p.m. at which time the following members of the Board of Appeals were present: Clara L. Keliinui, Michael Makunas and Linda Hendricks. The petitioner's property consists of 14.2 acres of land and buildings located on Route 130 in Mashpee and being the same property described in deed recorded in Barnstable Registry Of Deeds in Book 1652, Page 69. The petitioner wishes to operate a group home for male and female adolescent children to provide a structured environment, care and discipline and to engender in the adolescents responsibility for themselves and to society. Hearing was attended by approximately 35 persons, many of whom were former and present residents of. DARE, and staff personnel. Letters were received from various agencies favoring the petition. One letter was received from the father of a former DARE resident registering opposition to the petition. A vote of registered voters of Mashpee reflected 15 in favor and 7 opposed. After careful consideration of all information made available to this board and inspection of the DARE premises, the Board of Appeals has unanimously voted to deny a Special Permit
