I • <br /> I <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS i <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 I` <br /> RE: Application of PETERS ENTERPRISES <br /> for zoning variance <br /> June 4, 1976 <br /> DECISION <br /> A petition was duly filed by the petitioner for a variance ! <br /> to Section 6.3 ; paragraph D-1, of the Zoning By-laws as pertains <br /> to Land Use Regulations in a R-1 zoned area. <br /> Notice was duly given to abutters and owners of land next ad- <br /> joining the land of abutters. Notice was given by publishing in <br /> the Falmouth Enterprise, d newspaper of general circulation in the <br /> Town of Mashpee on March 12, 1976 and March 19 , 1976, a copy of <br /> such notice being appended hereto. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, April 7, 1976, at 7 :30 p.m. at which time the <br /> following members of the Board of Appeals were present: Michael <br /> A. Makunas, acting chairman; B. Jean Thomas and Linda Edson Hend- <br /> ricks. <br /> The petitioner' s property consists of land located on Lot 1, <br /> Route 28 and High Sachum Road, Route 28 a 60 foot wide way and <br /> High Sachum Road a 40 foot wide way. ' Dimensions of this lot are <br /> 125 feet in width,,-fronting on Route 28, a 200 foot westerly side- <br /> line on High Sachum Road, a 200 foot easterly sideline and a 100 <br /> foot northerly rear lot line. Total land area consisting of <br /> 25,009 square feet of land. The petitioners feel that there is <br /> strong evidence that the location of this residentially zoned <br /> lot on 28, a highway of heavy, fast traffic, has made the lot <br /> highly unsuitable for residential purposes. The danger of raising <br /> a family on this major highway has, and will continue to, dis- <br /> courage families from constructing a home on this lot. The noise <br /> and fumes emanating from this highway further contribute to the <br /> unsuitable nature of this lot for residential purposes. <br /> Further, the adjoining lot currently has under construction <br /> a Karate studio. This studio will in all likelihood encourage a <br /> variety of commerce which would seriously disturb the quietude <br /> of petitioners lot and further contribute to its unsuitability <br /> for residential use. <br />
