RE: Application of PETERS ENTERPRISES <br /> for zoning variance <br /> Page 2 <br /> Also, they feel the proximity to the public disposal area, <br /> while not a major problem in itself, contributes to this problem. <br /> Finally the fact that the lot has a moderate gully has ren- <br /> dered it unsuitable or extremely costly for residential use. <br /> Taking into consideration all these facts, the petitioners <br /> who have owned this lot for ten years and have held it out for <br /> sale during this period, feel that they are suffering a hardship <br /> and will continue to suffer this hardship if literal enforcement <br /> of the By-law is required. They feel that there is no evidence <br /> that granting a variance would harm the public good in the least. <br /> The location of the building on this land would meet all zoning <br /> By-laws for set back and side line requirements. Access to the <br /> building would be from High Sachum Road as opposed to Route(: 28. <br /> Petitioners also state that the building would generally conform <br /> to the existing buildings in the area. <br /> The meeting was attended by some fourteen people, all who <br /> voted in favor. The only opposition came from a phone call from <br /> Mr. George Benway, objecting as a concerned citizen. The board <br /> voted two to one in favor of the variance. The two were in favor <br /> for the following reasons : <br /> 1) Owing to conditions specially affecting this piece <br /> of property but not affecting generally the zoning <br /> district in which it is located, <br /> 2) A literal enforcement of the By-laws would involve <br /> a substantial hardship financial or otherwise to: the <br /> applicant, and <br /> 3) Desirable relief may be granted without substantial <br /> detriment to the public good. <br /> The one opposing voter was for the following reasons : <br /> 1) The member feels a hardship does not exist, and <br /> 2) Such a variance defeats the purpose of the Town Zoning By-laws. <br /> Michael A unas <br /> B. can T Inas <br /> `* <br /> Linda Edson Hen ricks /atJDL <br /> `k Q 3 1379 <br /> i <br />
