-Ofi TOWN OF MASHPEE
i BOARD OF APPEALS
e TOWN HALL, MASHPEE, MASSACHUSETTS 02649
p Cp DECISION
Rei Petition of L & 0 Associates and Louis A. Lapio Co: , Inc, d/b/a
Century 21-1apio Real Estate for a Variance
A petition was filed by L & 0 Associates and Louis A. Lapio
Co. , Inc. , d/b/a Century 21-Lapio Real Estate for a Variance under
Section 6.3 by application of Section 6.23 of the land Use Regulations,
for permission to change the use of said parcel located on the corner
of Somerset and Sandwich-Cotuit Road, Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Mass-
achusetts General Laws, Chapter 40A. Notice was also given by publishing
in the Falmouth Enterprise, a newspaper of general circulation in the
Town of Mashpee, on November 4, 1980 and November 11, 1980, a copy of
which is attached hereto and made a part hereof.
A public hearing was held on the petition at the Mashpee Town
Hall on Wednesday, November 19, 1980, at 8:30 p.m. at which time the
following members of the Board of Appeals were present and acting through-
out: Robert J. Houle, Michael Makunas, Raymond G. Sweeney.
It was explained that the Petitioner's request for variance was
for permission to operate a Real Estate Office, within a subdivision, to
extend the sales outside the subdivision, to the surrounding areas.
At the onset of the hearing, Mr. Michael Dunning, attorney
for the Petitioner, indicated that he wished to amend this petition to a
request for a Special Permit (which could be limited in time or on a
temporary basis). The Board consented to this request and heard the
matter as a request for a Special Permit.
Testimony was taken both in favor of, and in opposition, to the
granting of a Special Permit .
