Upon motion duly made and seconded the Board voted unanimously <br /> to deny the Petition for a 'Special Permit. <br /> The Board found that the granting of this Special Permit would <br /> not be in harmony with the general purpose and intent of the Zoning <br /> By-laws. The Board further found that the proposed use would increase <br /> the traffic in this residential neighborhood. <br /> In order to avoid a triumph of form over substance, the Board <br /> also considered whether the Petitioner might be entitled to a "Use Variance" <br /> under Section 12.6 of the Zoning By-law. The Board found that the <br /> Petitioner would not be entitled to a use variance as a literal enforcement <br /> of the provisions of the ordance or by-law would not involve substantial <br /> hardship, financial or otherwise, to the Petitioner, and that a granting <br /> of the Variance would involve substantial detriment to the public good and <br /> would nuffily, and substantially derogate from the intent and purpose of <br /> the pertinent by-law. <br /> MASHPEE BOARD OF APPEALS <br /> BYi <br /> Deny <br /> Robert J.
