TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> . , TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> h' <br /> DECISION <br /> Re: Petition of Donald Blakeman for a Variance <br /> A Petition was filed by Donald Blakeman, of Mashpee, <br /> Massachusetts requesting a variance under Section 7.4 of the Land <br /> Space Requirements, for permission to vary the minimum side line <br /> requirements, on property located on Lot 29, Santuit Pond Road, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A as amended by Chapter 808 <br /> of the Acts of 1975• Notice was given by publication by publishing <br /> in the Falmouth Enterprise, a newspaper of general circulation in <br /> Town of Mashpee on October 21, 1980 and October 28, 1980, a copy of <br /> which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, November 5, 1980 at 8:00 p.m. at which time <br /> the following members of the Board of Appeals were present and acting <br /> throughout: Michael Makunas, Raymond G. Sweeney, Peter Muse. <br /> The Petitioner explained to the Board that he was in the <br /> process of constructing a house, and upon completion of the foundation, <br /> it was discovered that the foundation was in voilation of the zoning <br /> by four feet. <br /> Upon motion duly made and seconded, the Board voted unanimously <br /> to grant the request for variance as requested. <br /> The Board found that the Petitioner established, to the <br /> satisfaction of the Board, a hardship unique to the particular property. <br />
