' RX, g <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> p� DECISION <br /> Ret Petition of John Umina for a Special Permit <br /> A Petition was filed by John Umina, of Mashpee, Massachusetts, <br /> requesting a special permit under Section 9, of the land Use Regulations <br /> for permission to erect condominiums and multi-family dwellings on <br /> property located on Route 28, between Quinaquisset Avenue and Straw- <br /> berry lane, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General laws, Chapter 40A. Notice was also given by <br /> publication in the Falmouth Enterprise, a newspaper of general circu- <br /> lation in the Town of Mashpee on October 21, 1980 and October 28, 1980, <br /> a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition by •the Board of <br /> Appeals, at the Mashpee Town Hall on Wednesday, November 5, 1980, at <br /> 8130 p.m. <br /> A presentation was made to the Board indicating their intention <br /> to construct a multi-family condominium development on the property. <br /> Subsequent to the hearing, the Petitioner had several meetings with <br /> the Mashpee Planning Board. . <br /> The Board found that the use of the premises would not be <br /> detrimental to the Town or area by reason of excessive traffic noises <br /> or demand upon community facilities. The Board also established .that <br /> granting a permit would be in the best interests of the community and <br /> would be in harmony with the general purpose of the by-laws. <br />
