b. One outdoor swimming pool which may, at a later date, <br /> be enclosed for year-round use <br /> c. A pier and temporary float to accommodate loading and <br /> off-loading of residents and guest boats. <br /> The Board found that the proposed development of the land <br /> described is the best use of the land and more suitable than the allowed <br /> use already granted as a single lot subdivision, and that the use of the <br /> premises would not be detrimental to the Town or area by reason of excessive <br /> traffic noise or demand on community facilities. The Board also established <br /> that granting the permit would be in the beat interest of the community, and <br /> would be in harmony with the general purpose and intent of the ordanances.or <br /> By-law, and that the Petitioner met or exceeded the requirements for a <br /> multi-family unit development as provided for in the zoning By-laws, Town <br /> of Mashpee, and the Planning Board. <br /> Upon motion duly made and seconded the Board voted unanimously <br /> to grant the request for a Special Permit to D. S. & B. Realty Corporation <br /> and to incorporate the following conditionsi <br /> 1. This Special Permit authorizes the construction of <br /> a 30-unit condominium complex together with the ammenities <br /> as showni and does not allow a multi-family rental development <br /> use. <br /> 2. The developer must maintain the roads, sidewalks, utilities, <br /> and provide snow removal, until the condominium unit owners <br /> association takes over control of the property, or until the <br /> units are eighty percent (80%) sold, whichever comes last, at <br /> which time the condominium unit owners association is to <br /> maintain roads, sidewalks, utilities, and provide snow removal. <br /> 3. The tennis courts will be restricted to the unit owners and <br /> their guests, and shall not be open to the public, and public <br /> memberships shall not be permitted. <br /> 4. All signs shall be constructed of wood, and if illuminated, <br /> illuminated from the exterior. The sign should be in harmony <br /> with the aesthetics of the area. <br /> -2- <br />
