AMENDED DECISION <br /> The plan of the landscaping, parking, ingress and egress <br /> roads and site of the market was discussed. Mr. Sweeney agreed <br /> to secure an estimate of the cost of the landscaping to assist <br /> the Board in arriving at an agreed amount for a cash surety <br /> bond to insure the compliance by applicant with the plans. <br /> The comments and recommendations of the Design Review Committee <br /> were adopted by the Board. <br /> The Board voted unanimously to grant the Special Permit <br /> subject to the imposition of the following conditions, both <br /> as to use and length of time, it being the decision of the <br /> Board that these conditions would insure that the proposed use <br /> would not be detrimental to the neighborhood or the general <br /> welfare of the inhabitants of the Town and would be consistent <br /> with the general purpose and intent of the zoning by-law. <br /> CONDITIONS <br /> 1. The approved landscape, parking and plot plan, which <br /> shows landscaping parking spaces, traffic flow, ingress <br /> and egress from and to Route 28 and the area of the <br /> proposed flea market use shall be followed by the applicant <br /> in all respects and prior to opening for business, the <br /> applicant is to notify the Building Inspector in writing, <br /> and he will review the site and authorize applicant, in <br /> writing, to open for business if all conditions contained <br /> in the landscape, parking and plot plan and in this <br /> decision, have been complied with or satisified. <br /> 2. In lieu of immediate completion of landscaping and <br /> other improvements as shown on the plans, the petitioner <br /> may post a bond with surety approved by the Board of Appeals <br /> or cash surety, in the amount of $1, 000. 00 in a form <br /> acceptable to the Board cgnditioned upon the completion <br /> of all landscaping not later than three (3) months from <br /> the date of issuance of the occupancy permit by the <br /> Building Inspector. The bond shall be filed with the <br /> Board within two (2) weeks of the issuance of the building <br /> permit. When landscaping and the improvements are com- <br /> pleted, as certified in writing by the Building Inspector <br /> and accepted by the Board, the cash surety shall be return- <br /> ed to applicant. The cash surety will be held by the <br /> Town Treasurer. <br /> 3. The applicant must comply with all State and County <br /> and Town health laws and regulations in the operation of <br /> the flea market. <br /> 4. The applicant will arrange to provide a police officer <br /> to control traffic on Route 28 at the entrance to the flea <br /> market on Saturday and Sunday, for such hours as may be <br /> required by designation by the Chief of Police. <br />
