All displays, sales and flea market operations shall be located at <br /> the rear of the current site of the Mini-Golf and Ice Cream Shop <br /> operations. <br /> 12. The Applicant shall erect a stockade fence shielding the dumpster <br /> or other trash disposal receptacle and the farm tractor or any other <br /> equipment used in connection with the maintenance and conduct of the <br /> business, so that the same may not be seen from any road or from any <br /> abutting property. <br /> 13. The Applicant shall maintain the site to remove paper, garbage and <br /> •other debris from the grounds and shall trim all excessive vegetation, <br /> meaning grass shall be mowed and landscaping maintained in a neat and <br /> orderly manner, and parking areas and routes of vehicle travel shall <br /> be maintained in a neat-and hard packed appearance. The site shall <br /> be graded so as to maintain a level area pitched to drain away from <br /> abutting roads and property and to minimize the pooling of water. The <br /> grade of the site shall be maintained as presently exists and all drainage <br /> originating from the site shall be self-contained on the site. <br /> 14. This grant of Special Permit is not transferable by the Applicant <br /> except to members of his immediate family, meaning spouse and children, <br /> and will expire upon the expiration of the Applicant's lease of the <br /> land but no later than December 31, 1989. <br /> 15. The grant of this Special Permit is expressly conditioned upon compliance <br /> with the limitations and conditions imposed herein and in the event <br /> of any alleged violation thereof and subsequent findings by the Board <br /> of Appeals, after notice and hearing, that a substantial violation has <br /> willfully occurred, this Special Permit may be rescinded by unanimous <br /> vote of the Board of Appeals. <br /> 16. No food products of any type shall be allowed to be sold within the <br /> boundaries of the flea market with the exception of the hot dog stand <br /> which must meet the state sanitary code requirements and be licensed <br /> by the Board of Health. <br /> All cosmetics and non-prescription medical supplies must be in the original <br /> sealed package or container. No outdated products or open samples are <br /> allowed. Unannounced spot inspections will be made by the Board of <br /> Health agents at any time. <br /> Adequate sanitary facilities shall be made available to the general <br /> public attending the flea market. <br /> 17. At their discretion, the Mashpee Board of Health may waive any or all <br /> provisions listed in condition 1116 of this Special Permit <br /> 18.
