Idward-R.. Wasil SP-89-01-12 x F Page 3. 11. All displays, sales and flea market operations shall be located at the rear of the current site of the Mini-Golf and Ice Cream Shop operations. 12. The Applicant shall erect a stockade fence shielding the dumpster or other trash disposal receptacle and the farm tractor or any other equipment used in connection with the maintenance and conduct of the business, so that the same may not be seen from any road or from any abutting property. 13. The Applicant shall maintain the site to remove paper, garbage and •other debris from the grounds and shall trim all excessive vegetation, meaning grass shall be mowed and landscaping maintained in a neat and orderly manner, and parking areas and routes of vehicle travel shall be maintained in a neat-and hard packed appearance. The site shall be graded so as to maintain a level area pitched to drain away from abutting roads and property and to minimize the pooling of water. The grade of the site shall be maintained as presently exists and all drainage originating from the site shall be self-contained on the site. 14. This grant of Special Permit is not transferable by the Applicant except to members of his immediate family, meaning spouse and children, and will expire upon the expiration of the Applicant's lease of the land but no later than December 31, 1989. 15. The grant of this Special Permit is expressly conditioned upon compliance with the limitations and conditions imposed herein and in the event of any alleged violation thereof and subsequent findings by the Board of Appeals, after notice and hearing, that a substantial violation has willfully occurred, this Special Permit may be rescinded by unanimous vote of the Board of Appeals. 16. No food products of any type shall be allowed to be sold within the boundaries of the flea market with the exception of the hot dog stand which must meet the state sanitary code requirements and be licensed by the Board of Health. All cosmetics and non-prescription medical supplies must be in the original sealed package or container. No outdated products or open samples are allowed. Unannounced spot inspections will be made by the Board of Health agents at any time. Adequate sanitary facilities shall be made available to the general public attending the flea market. 17. At their discretion, the Mashpee Board of Health may waive any or all provisions listed in condition 1116 of this Special Permit 18. The signs on Great Neck Road are to be removed prior to the 1989 opening unless sign permits are obtained. a
