Peters, Jr. TR) - hereby appeals the Building Inspector's <br />decision regarding signage at the premises located at 681 Falmouth Road <br />(Map 81, Lot 23) Mashpee, MA. <br />Members sitting: W. Hanrahan, M. Makunas, C. Hawver <br />Attorney Kevin Kerraine represented this petition. He explained that <br />he had filed the appeal to preserve the rights of his client and to afford <br />an opportunity to investigate if there was any grandfathering protection. <br />He said it did not appear that there was any grandfathering and he requested <br />to withdraw the petition without prejudice. <br />Mr. Makunas moved to accept the request to withdraw without prejudice. <br />Mrs. Hawver seconded. Peters, Jr. TR) - Requests a Variance under Sections 10.3.7 <br />and 10.6.4 of the Zoning By-laws pertaining to signs on property located <br />at 681 Falmouth Road (Map 81, Lot 23) Mashpee, MA. <br />Members sitting: W. Hanrahan, M. Makunas, C. Hawver <br />• Attorney Kevin Kerraine represented this petition. He showed photographs <br />of signs on the premises of Deer Crossing Market -- one showing the "Open" <br />sign and another advertising a product. He also showed photographs of neon <br />gaseous -type signs used in Mashpee Commons. <br />Douglas Boyd explained that Mashpee Commons has a Variance for signs <br />and permits the use of neon gaseous -type signs on buildings which cannot <br />be seen from either Route 28 or 151. <br />Mr. Kerraine stated that his client considers the use of the signs <br />essential to the operation of his business. The store is primarily a convenience <br />store with the name of Market and customers may not be aware of the availability <br />of malt beveragesin this type of store. The other request for a Variance <br />under 10.6.4 related to the sign coverage on the window. Mr. Kerraine said <br />his client can comply with the 10% requirement and no longer is petitioning <br />for this Variance. <br />No abutters were present. <br />Mr. Makunas moved to take the petition under advisement.
