BOARD OF APPEALS <br />MINUTES' <br />January, ll, 1989. <br />At 7:30 p.m. on Wednesday,.•January.11, 1989, the bard of Appeals held <br />a maeting at the Mashpee Town Hall. 'Board.members preseiu and acting: <br />throughout were: William Hanrahan, Cheryl Hiwve•r, Michael Makunas, <br />Richard Halpern and Edward'Govoni.'. Mr,. Douglas Boyd, Building Inspector, <br />was fn attendance. <br />MELVIN AND MARCELLA BRADSHAW - Request a Special Permit under Section <br />b.,3.I.9 of the Land Use Requirements for permission, to construct a wooden.:. <br />'dpck.with two floats in an R-3 zoning district.on property located. at <br />54 Popponesset Island Road.(Map 106, Lot 25) Mashpee, MA. <br />Members sitting: W. Hinrahan,.M. Makunas, C. Hawver <br />Christopher Costa of All CapeAurvey,represented the petition. He " <br />explained that he was requesting a modification of the previously approved <br />dock. He said that the Conservation Commission and Shellfish Constable <br />had found that an accumulation of alleufial drift had resulted in water <br />t shallower than two years ago when first sounding were taken. The depth <br />is not now adequate for Mr. •$radshaci.'s boat. <br />Mr. Costa recommended extending the dock to 70 feet but Conservation <br />would not approve without a new application for::a Special Permit: He. <br />had no new environmental data but had reviewed plans with the Harbormaster <br />who had no;problem with navigability. <br />Lisa Hanscom, Conservation Offices;, said that the Conservation Commission <br />was concerned with the lack of shellfish studies and it was the Applicant's <br />decision to withdraw his petition:to the. Copse zyationtCommission. <br />Paul Somerville, Shellfish Constable, voiced opposition to the dock <br />due to expected damage to shellfish beds. He said that the placing of <br />pilings disrupts the beds and that ice damage to the pilings has been <br />common in the area. He proposed a minimum buffer distance of two feet <br />of water before any propeller disturbance could be felt. He presented <br />EL letter from Virginia Fay df the Division of Marine Fisheries stating <br />that information on the proposed dock was incomplete. <br />Clark Hill, an immediate abutter, spoke in opposition to the.size <br />of the dock. Mr. Hanrahan read a comment from another abutter, Dr. Shamish, <br />Stating his objection. Lisa Hanscom stated that she agreed. with Paul.; <br />Somerville that this is the wrong habitat .for a dock. - <br />Mr. Hanrahan read Section 6.3.I.9 of the Zoning By-laws and said <br />that ftiformation received at hearing indicated questions of environmental <br />damage. <br />Mrs. Hawver moved to deny the petition with prejudices Mr. Hanrahan <br />seconded. All agreed.' <br />
