Board of Appeals Minutes - March 13, 1996 2. <br /> Kostas and Ina K. Nenortas -Request a Variance from Section 174-31 of the Zoning By- <br /> laws for permission to vary the minimum lot size requirements to allow the construction of <br /> a single family house on property located in an R-5 zoning district at 134 Pimlico Pond <br /> Road (Map 2, Block 138)Mashpee, MA. <br /> Members sitting: E. Govoni, R. Nelson, K. Marsters <br /> Attorney John Alger represented the applicants and reviewed plans of several lots which <br /> the Nenortas purchased in 1968 and subdivided the land in 1986. He said one lot (Lot 4) <br /> was conveyed into a trust. He said the vacant lot has been assessed for $100,000 and both <br /> adjoining lots have houses on them. He said the vacant lot is 1.16 acres, substantially <br /> larger than other lots in the area and slopes off rapidly from the road to the lake. He said <br /> the shape and topography of the lot create a hardship in its use. He said the owners <br /> cannot acquire any land from adjoining lots. <br /> Alec Watt, an abutter, said he did not think lot size was an issue and questioned the <br /> hardship. He said the lots were subdivided in 1986 and were grandfathered for six years. <br /> He said the change in zoning was to create larger lots and questioned if the applicants <br /> would be seeking variances for other land across the street. Mr. Govoni reviewed the <br /> plans and noted that the lots in the area are of similar size. Mr. Watt said that five <br /> residences converge on one driveway and asked that the record show a citation of Mitchell <br /> v. ZBA of Revere on undersized lots. <br /> Mr. Alger said the applicants are only seeking relief for the subject lot and not other land <br /> they own in the area. He said the hardship is not only the size but the topography and <br /> shape of the lot and the absolute impossibility to add on to it. He said that since the lot is <br /> similar to many others in the area and as it exists has no other use. <br /> Mr. Govoni moved to take the application under advisement. Mr. Nelson seconded. All <br /> agreed. <br /> Michael J. and Andrea L.
