Board of Appeals Minutes - January 17, 1996 2. <br /> William B. and Betsey ng ebin -Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the frontage and lot size requirements to allow the <br /> construction of a single family home on each of two lots located in an R-5 zoning district <br /> at 46 and 50 Hilltop Road (Map 41, Blocks 68 and 69)Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, K. Marsters <br /> Attorney Kevin M. Kirrane represented the applicant and informed the Board that the <br /> applicants have owned the two lots since 1967 and were not aware of changes in the <br /> zoning by-laws which were voted in May 1990. He said the wording of the Town by-law <br /> change was difficult to understand. He explained that taxes and water and street <br /> betterments have been charged by the Town for two separate buildable lots. He stated <br /> that the Briarwood Association has invoiced them for two lots. He said the lots are <br /> consistent in size with most lots in a area on which single family homes have been <br /> constructed and that it would be a hardship to be prevented from building on both lots. <br /> Mr. Govoni read a letter from an abutter concerning drainage on the lots. Mr. Govoni <br /> explained that the Board was submitting an article for Town Meeting to provide for a <br /> correction period for this type of problem. Mr. Govoni moved to take the application <br /> under advisement. Mr. Marsters seconded. All agreed. <br /> Arnold B. Tofias -Requests a Variance from Sections 174-31 and 174-47.B.9 of the <br /> Zoning By-laws for permission to vary the lot coverage requirements on property located <br /> in an R-3 zoning district at 34 Wheelhouse Lane(Map 120, Block 163)Mashpee, MA. <br /> The applicant proposes to enclose a section of an existing deck with a section of the <br /> screened-in porch extending beyond the existing deck line as a cantilever. <br /> Members sitting: E. Govoni, J. Regan, R. Nelson <br /> Engineer M. Grotzke represented the applicant and reviewed plans for the enclosure of <br /> part of a deck and addition of a porch of 51 square feet. The lot coverage would be <br /> increased from 21% to 22%. No comments were received from abutters. <br /> Mr. Govoni moved to grant the Variance. Mr. Regan seconded. All agreed. <br /> Michael J. and Andrea L. Yanoff <br /> Members sitting: E. Govoni, J. Regan, K. Marsters <br /> Mr. Grotzke asked for a continuance to January 24, 1996 to enable him to submit revised <br /> plans. Mr. Govoni said that he should review the proposals with the Conservation <br /> Commission. <br />
