Board of Appeals Minutes/April 1.0 , 1996/Paye 3 <br /> Doe Family Trust/99 West Inc. - Requests a Variance from Sections <br /> 174-55 .B.C.F.and G. of the Zoning By-laws for permission to <br /> allow internal illumination of signs, exceed the maximum <br /> signboard area and locate a freestanding sign 12 ' from the lot <br /> line on Great Neck Road North on property located in a C-1 zoning <br /> district at 8 Ryan' s Way (Map 67 Block 75) Mashpee, MA. <br /> Doe Family Trust/99 West Inc. - Requests a Special Permit under <br /> Section 174-55.B.C.F. and G. of the Zoning By-laws for a free <br /> standing sign and a sign affixed to the exterior of a restaurant <br /> building on property located in a C-1 zoning district at 8 Ryan' s <br /> Way (Map 67, Block 75) Mashpee, MA. <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Mr. Dana G. Doe was present to discuss the 99 Restaurant and <br /> Pub. Mr. Govoni stated that recommendations were made to lower <br /> the sign and dress the pole with the same color as the building. <br /> Design Review sent memos out pertaining to the sign and there <br /> was no correspondence. <br /> Mr. David McNamara, Ms. Carla Roy, Mr. John Renz , and Mr. Domingo <br /> Penn were also present for this discussion. Ms. Roy requested <br /> the logo (horse shoe) be lowered and the sign reduced; she <br /> further expressed preference for the 3 ' 6" size with the wider <br /> base (Exhibit A) . Mr. Renz expressed concern about the use <br /> of interior lighted signs and the precedent this will set in <br /> the town which has been using spotlights and wooden signs . <br /> Mr. Govoni stated that signs will be reviewed on a case by case <br /> basis, and there is a Sign Committee to review these. Mr. Doe <br /> agreed to leave the sign 3 ' 6" (per Exhibit A) , lower the logo, <br /> use the wider base and paint it grey. Mr. Doe further noted <br /> that $40, 000 of landscaping is planned. <br /> Mr. Govoni moved to grant the Variance to allow internal <br /> illumination of a submitted sign with maximum square footage <br /> of 45 ' , with the height of the sign 10 ' 10" to the top of the <br /> logo and the wide base 3 ' 6" from the grade, in same grey as the <br /> Restaurant, located 12 ' from lot line on Great Neck Road, the <br /> finding being relief may be granted without derogating from <br /> the intent of the By-law as the internally lit sign only <br /> illuminates the lettering and not the body of the sign and it <br /> could be done with a backlit sign (which is not as <br /> tastefully done) which is allowed in this By law. The sign <br /> has gone through Design Review, has been put up on the site, <br /> has had Memos sent out to all interested parties and within <br /> 3 weeks there has been no written opposition. The Doe Family <br /> Trust has agreed to lower the logo into the sign in response <br /> to the verbal opposition presented. Ms. Hawver seconded. All <br /> agreed. <br />
