BOARD OF APPEALS <br /> MINUTES <br /> Wednesday, July 24, 1996 - 7:30 P.M. <br /> The Mashpee Board of Appeals held a meeting on Wednesday, July 24, 1996 at 7:30 P.M. <br /> at the Carol H. Jacobson Senior Center. Board Members present and acting throughout <br /> were Edward M. Govoni, James E. Regan 1II, Cheryl A. Hawver, Robert G. Nelson and <br /> Richard T. Guerrera. Building Inspector William F. Hauck was in attendance. <br /> Reorganization of the Board <br /> Ms. Hawver nominated Edward M. Govoni as Chairman. Mr. Regan seconded. All <br /> agreed. Mr. Govoni nominated Mr. Regan as Vice-Chairman. Ms. Hawver seconded. <br /> All agreed. Mr. Govoni nominated Ms. Hawver as Clerk. Mr. Regan seconded. All <br /> agreed. <br /> Joseph Daniele et al. -Mr. Daniele presented the Board with a request to withdraw his <br /> appeal without prejudice. Mr. Govoni moved to grant the request to withdraw without <br /> prejudice. Mr. Regan seconded. Ms. Hawver made the vote unanimous. <br /> Randy Bern - Requests a Variance from Section 174-25.I.9 of the Zoning By-laws for <br /> permission to exceed the 70 foot dock length limit to allow for the extension of an <br /> existing dock to 153 feet on property located in an R-3 zoning district at 10 Wheelhouse <br /> Lane (Map 120/Block 156)Mashpee, MA. (Owner of record: Chilton Development Co. <br /> Inc.). <br /> Members sitting: E. Govoni, J. Regan, C. Hawver <br /> Ms. Hawver stated that this was a Chapter 112 hearing since taxes are owed on the <br /> property. Engineer Michael Grotzke represented the applicant and explained that both the <br /> Shellfish Warden and Conservation Commission had agreed that the extension of the dock <br /> would mitigate environmental impacts on the bottom of the bay. Mr. Govoni explained <br /> that the dock had a Special Permit issued in 1987 to Angelo and Thalia Toyias. <br /> Mr. Gerald Epstein, an abutter, said he has a dock in the area and was limited in length <br /> and asked if the Board would allow him to extend his dock in order to reach deeper water. <br /> Mr. Govoni explained that he would have to go to Conservation, Harbormaster or <br /> Shellfish Warden. He said that currently those departments are recommending longer <br /> docks. <br />
