Board of Appeals Minutes- January 24, 1996 4 <br /> authority of the Board of Health. Mr. Baker stated that he did not believe it was solely a <br /> Board of Health decision. <br /> Mr. Doe said they have been working with the Board of Health and were not in the <br /> sensitive recharge area of the river. He said they would agree to the denitrification system <br /> if required by the Board of Health. Mr. Marsters stated that they may want to include it <br /> and John Renz of Fields Point said they are required to add it to their treatment plant. <br /> There was discussion from abutters of the landscaping and entrance to the property and <br /> hours of operation. Mr. Doe said food would be served until 11:30 P.M. <br /> Mr. Govoni moved to grant a 51' Variance from Section 174-40 between the radius of the <br /> entryway into the complex from the property line on Great Neck Road and 110' Variance <br /> from the radius into the condominium complex on Ryan's Way. He also moved to grant a <br /> Variance under Section 174-38 to vary the size of the parking spaces from 9' x 20' to 9' x <br /> 18'. Mr. Regan seconded. All agreed. <br /> Mr. Govoni moved to grant the Special Permit to construct a 158 seat restaurant subject <br /> to the following conditions: <br /> 1. the septic system be designed to reduce the nitrate loading into the ground area <br /> 2. a stop sign be installed at the entryway from Ryan's Way <br /> 3. a landscape bond be posted with the Town Treasurer for $40,000. <br /> Mr. Govoni found that the use is consistent with the By-laws and would not be a <br /> detriment to the neighborhood. Mr. Regan seconded. All agreed. <br /> Alice K. Mellian/Rose Z. Karibian -Mr. Govoni stated that the Board had received a <br /> request for a 6-month extension on the Variance for Alice K. Mellian and Rose Z. <br /> Karibian. Mr. Govoni moved to grant the extension. Mr. Marsters seconded. All agreed. <br /> Mr. Regan stated that he would use the Rule of Necessity in voting on this extension. <br /> Deer Crossing -Mr. Govoni moved to permit a minor modification in the landscape plan <br /> for the Deer Crossing Building E to eliminate the five Norway maple trees.
